Decision(s): Under Article 18(4) of the Public Finances (Jersey) Law 2019 (the Law), the Minister for Treasury and Resources hereby notifies the States, and having consulted with any relevant Minister under Article 18(5) of the Law; that she has agreed to the following –

After the expiry of 4 weeks following the presentation to the States of these transfers, the Minister hereby authorises the Treasurer of the States to action the transfers outlined in the table above.

Background

JPH was established with core responsibility for providing efficient and effective

management of the public estate and ensuring that the operational requirements of departments  were  properly  served,  compliant  and  the  full  cost  of  occupying property  was  correctly  accounted  for.  A  Ministerial  Decision  was  made  to reintegrate  Government  of  Jersey  properties  into  JPH  and  be  responsible  for managing the estate in line with the Corporate Island Public Estate Strategy 2021 – 2035.

  As part of the Property Consolidation' initiative for JPH to manage the entire public

property portfolio, the department has been working with JHA regarding taking- over the management of the properties listed at the end of this report.

In summary, this will involve:

JPH taking over the responsibility of the landlord maintenance of the Properties;

JPH taking over the lease management of the houses from the Prison Service, including receiving the rental income from the tenants (presently Prison Officers) and the houses from the Jersey Field Squadron; and

Changes to tenancies and new tenants will be by agreement between JPH and JHA.

Recommendation

The Minister is recommended to approve a recurring transfer of expenditure budget of £75,000 and income budget of £203,000 from JHA to Infrastructure with effect from 1 January 2024.

Reasons for Decision

The Island Public Estate Strategy 2021-35 sets out the framework for the management and development of current and future Government of Jersey assets, providing an assessment of existing assets and defines the vision, aims and objectives for the Estates Strategy in the context of the current economic and financial environment, while balancing future needs and aspirations of the island.

This transfer will enable JPH to provide consistent and effective management of the transferred properties to retain their value and safety standards and provide a complete corporate holistic overview of the government estate.

Article 18(1)(a) of the Public Finances (Jersey) Law 2019 states that a specified amount appropriated for one head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure that is set out in the government plan.

Article 18(4) of the Public Finances (Jersey) Law 2019 states that the Minister shall give the States Assembly at least 4 weeks' notice before an amount is transferred under paragraph (1)(a).

Article 18(5) of the Public Finances (Jersey) Law 2019 states that if a direction under this Article would affect a head of expenditure that relates to the responsibilities of any Minister, that Minister must be consulted before the direction is made. The relevant Ministers have been consulted.

Resource Implications

The JHA net revenue head of expenditure to increase by an amount of £128,000 and the Infrastructure net revenue head of expenditure to decrease by an identical amount.

This decision does not change the total amount of expenditure approved by the States in the Government Plan 2024-2027 and the transfer will be reflected in the next Government Plan 2025-2028 cash limits.
