EXECUTIVE SUMMARY

On 26 November 2024, Jersey, alongside 47 other jurisdictions including Guernsey, the Isle of Man, and the United Kingdom, signed the Multilateral Competent Authority Agreement  (MCAA)  on  the  Organisation  for  Economic  Cooperation  and Development's (OECD)'s new Crypto-Asset Reporting Framework (CARF) at the 17th OECD Global Forum Plenary Meeting. At the present time, 50 jurisdictions have signed the CARF.

This  multilateral  tax  agreement  is  made  under  the  framework  of  the  OECD's Multilateral Convention on Mutual Administrative Assistance in Tax Matters, which was extended to Jersey with effect from 2015, and represents a new global minimum standard for transparency and the exchange of tax information.

BACKGROUND

During 2023, the OECD and the G20 approved the creation of a new global minimum standard on the automatic exchange of tax information held by Crypto-Asset Service Providers on their customers, the CARF. This was developed as a package alongside revisions to the Common Reporting Standard (CRS) on automatic exchange of financial account information, which will bring certain Crypto-Assets within the scope of the CRS for the first time, as well as making changes to the types of information reported, with the intention of improving the usefulness of information exchanges under the standard.

Jersey has a longstanding policy of support for the implementation of global minimum standards  in  transparency  and  the  exchange  of  tax  information.  Accordingly,  in November 2024, Jersey was one of 48 jurisdictions which committed to working towards a common global implementation date of 1 January 2026 for both the CARF and the revised CRS, with the first reporting and exchanges to be made in 2027.

The growth of the Crypto-Asset market is seen by global policy makers as creating significant challenges to tax transparency frameworks like the Common Reporting Standard (CRS), which are integral to tackling tax evasion, tax avoidance and non- compliance. Jersey was one of the earliest adopters of the CRS, being among the first group of jurisdictions to commit to the regime and then to exchange information from 2017.

Increasingly, concerns had been raised in the international tax community that crypto- assets  can  be  transferred  and  held  without  interacting  with  traditional  financial intermediaries and without any central administrator having full visibility. In addition, crypto-assets, as an asset class, may not fall within the scope of existing automatic exchange of information frameworks.

In response, the G20 gave the OECD a mandate in April 2021 to develop the CARF, a dedicated  global  tax  transparency  framework,  which  provides  for  the  automatic exchange of tax information on transactions in crypto-assets in a standardised manner with the jurisdictions of residence of taxpayers on an annual basis.

At the present time, 69 jurisdictions have committed to implement the CARF to start exchanges  by  2027  or  2028  at  the  latest,  as  part  of  the  Global  Forum's  CARF commitment process.

THE CARF

Under the CARF, Relevant Crypto-Asset Service Providers (RCASPs) must collect details of their clients (Crypto-Asset Users) and transactions in relevant crypto-assets, conduct due diligence procedures, and report relevant data to participating revenue authorities. These revenue authorities are required to exchange this data with the partner jurisdiction(s) in which the taxpayer is resident and to enforce compliance with the framework. The information provided by RCASPs is available for use by revenue authorities to identify tax non-compliance. It is important to highlight that appropriate safeguards will be put in place to ensure the protection of data security.

Under the CARF, an RCASP includes any individual, entity or arrangement which effectuates exchange transactions in crypto-assets as part of its business, or which makes available a platform which facilitates trading in crypto-assets. RCASPs must conduct due diligence in line with anti-money laundering requirements to identify their clients. They must further obtain a self-certification from the owners and beneficial owners of exchanges of crypto-assets, disclosing their jurisdiction(s) of residence and taxpayer identification numbers (TINs). RCASPs must undertake annual reporting of aggregate exchanges effectuated, split by type of crypto-asset on:

Exchanges between crypto-assets;

Exchanges between crypto-assets and fiat currencies and vice versa; and

Transfers of crypto-assets, including to un-hosted wallets, as well as certain payments made in crypto-assets.

Central  Bank  Digital  Currencies,  certain  specified  electronic money  products  and crypto-assets that cannot be used for payment or investment purposes are specifically excluded from being reported under the CARF, although they may be reportable under the amended CRS.

In a departure from the approach taken under the CRS, financial institutions must stop effectuating transactions for pre-existing customers who do not provide details of their tax information numbers or jurisdictions of tax residence by 31 December 2026.

EFFECTS OF THE CARF

The CARF is a global minimum standard in tax transparency. Jersey is fully committed to the implementation of global standards in tax transparency, a longstanding policy that is a cornerstone of the Island's reputation as a cooperative and transparent jurisdiction. The impact of any change to Jersey's reputation though non-adoption of international standards would be potentially severe.

69 jurisdictions have committed to implement the CARF to start exchanges by 2027 or 2028  at  the  latest  as  part  of  the  Global  Forum's  CARF  commitment  process. Jurisdictions which are considered to be, or to potentially become, material locations

for crypto-asset service providers have been identified by the OECD as jurisdictions of immediate relevance to the CARF. These jurisdictions are expected to commit to implement the CARF within this timeframe, and the majority have already signed the CARF MCAA. This process is intended to ensure the maintenance of the principle of the level-playing field among jurisdictions and reduce any risk of harmful competition by non-adopters.

The OECD has robust processes in place to identify and address any new jurisdictions which become material locations for crypto-asset services in the future, and it would be expected that these would be required to implement the rules in turn. Jersey was identified as a jurisdiction of immediate relevance to the CARF during 2024, and as a result was required to make a political commitment to implement the regime in advance of the signing ceremony at the Global Forum's November 2024 Plenary Meeting in Paraguay.

The number of businesses initially affected by the CARF is currently believed to be low, based on discussions with industry and the 2024 National Risk Assessment on virtual asset service providers. It is currently estimated that no more than twenty businesses will potentially fall within the scope of the CARF rules. This is likely to be much lower initially, although growth in virtual assets and virtual asset businesses may lead to additional businesses being brought within scope over time.

On the basis that, at present, a relatively small number of entities are likely to be within the scope of the CARF, it is expected that its implementation can be done through existing resources, at least initially.

CONSULTATION PROCESS

Government has been engaging with businesses involved in this sector, both through direct contact and briefings to relevant industry representative organisations. Officers from Treasury and Exchequer and External Relations also provided a written briefing to the Economic and International Affairs Scrutiny Panel in September 2024.

It will be necessary to implement legislation to give effect to the agreement. Revenue Jersey issued a  public consultation in November 2024 which covers the domestic implementation  of  the  changes.  Draft  legislation  is  being  prepared  based  on  the responses received to that feedback, which will be consulted on before bringing the legislation before the States Assembly for approval in the autumn of 2025.

NEXT STEPS

Subject to States Assembly approval of the legislation implementing the CARF in Jersey domestic law, the rules would then come into force from 1 January 2026. The first reporting deadline for Relevant Crypto-Asset Service Providers is expected to be 30 June 2027, after which the information would be exchanged with partner jurisdictions.

Bilateral  competent  authority  agreements  are  expected  to  be  agreed  with  certain jurisdictions for which it is not possible to exchange information under the Multilateral Convention, such as the UK, Guernsey and Isle of Man, in advance of the first global deadline for exchange of information under the CARF, 30 September 2027.

ANNEX I – Multilateral Competent Authority Agreement on Automatic Exchange of Information pursuant to the Crypto-Asset Reporting Framework

DECLARATION

I,  Thomas  F.  Le  Feuvre,  Director  of  External  Relations,  on  behalf of the Competent  Authority of the  Bailiwick of Jersey, declare that  it hereby agrees to comply with the provisions of the

Multilateral Competent Authority Agreement on Automatic Exchange of Information pursuant to  the  Crypto-Asset Reporting Framework

hereafter referred to as the "Agreement" and  attached to this Declaration.

By means of the present Declaration, the Competent  Authority of the Bailiwick of Jersey is to be considered a signatory of the Agreement as from 26 November 2024. The Agreement will come into effect in respect of the Competent  Authority of the Bailiwick of Jersey in accordance with Section 7 thereof.

MULTILATERAL COMPETENT AUTHORITY AGREEMENT ON AUTOMATIC EXCHANGE OF INFORMATION PURSUANT TO THE CRYPTO-ASSET REPORTING FRAMEWORK

Whereas,  the Jurisdictions of the signatories to  this  Multilateral  Competent Authority Agreement on  the Automatic Exchange of Information pursuant to the Crypto-Asset Reporting Framework (the ''Agreement") are Parties to, or territories covered by, the Convention on Mutual Administrative Assistance in Tax Matters or  the  Convention  on  Mutual  Administrative  Assistance  in  Tax  Matters,  as  amended  by  the  Protocol amending  the  Convention  on  Mutual  Administrative  Assistance  in  Tax  Matters  (the  ·•convention"); collectively  the  •·convention",  individually  the  "original  Convention"  or  the  "amended  Convention" respectively);

Whereas,  the Jurisdictions  intend  to  improve  international  tax  compliance  by  further  building  on  their relationship with respect to mutual assistance in tax matters;

Whereas, the Crypto-Asset Reporting Framework was developed by the OECD, with G20 countries, to tackle tax avoidance and evasion and improve tax compliance;

Whereas, the laws of the respective Jurisdictions require or are expected to require Reporting Crypto-Asset Service Providers to report information with respect to certain Crypto-Assets and follow related due diligence procedures, consistent with the scope of exchange contemplated by  Section 2 of this Agreement and the reporting and due diligence procedures set out in the Crypto-Asset Reporting Framework;

Whereas, it  is  expected that the laws of the Jurisdictions would be amended from time to  time to  reflect updates to the Crypto-Asset Reporting Framework and once such amendments are enacted by a Jurisdiction the term Crypto-Asset Reporting Framework would be deemed to refer to the updated version in respect of that Jurisdiction;

Whereas, Chapter III of the Convention authorises the exchange of information for tax purposes, including the exchange of information on an automatic basis, and allows the competent authorities of the Jurisdictions to agree to the procedures to be applied to such automatic exchanges;

Whereas, Article 6 of the Convention provides that two or more Parties can  mutually agree to  exchange specified information automatically, the actual exchange of the information will be on a bilateral basis;

Whereas, the Jurisdictions have in  place (i) appropriate safeguards to ensure that the information received pursuant to this Agreement remains confidential and is used solely for the purposes set out in the Convention, and (ii) the infrastructure for an effective exchange relationship (including established processes for ensuring timely,  accurate,  and  confidential  information  exchanges,  effective  and  reliable  communications,  and capabilities to promptly resolve questions and concerns about exchanges or requests for exchanges and to administer the provisions of Section 4 of this Agreement);

Whereas,  the Competent  Authorities  of the Jurisdictions  desire to  conclude this  Agreement to  improve international tax compliance with respect to  Crypto-Assets based on  automatic exchange pursuant to  the Convention, without prejudice to national legislative procedures (if any), and subject to the confidentiality, data safeguards and other protections provided for therein, including the provisions limiting the use of the information exchanged under the Convention;

Now, therefore, the Competent Authorities have agreed as follows:

  1. For the purposes of the Agreement, the following terms have the following meanings:
  1. the term "Jurisdiction·• means a country or a territory in  respect of which the Convention is  in  force or  in  effect under the original  or amended Convention,  respectively, either through  signature and  ratification  in  accordance with Article 28,  or through  territorial extension in accordance with Article 29, and which is a signatory to this Agreement.
  2. the term "Competent Authority'" means, for each respective Jurisdiction, the persons and authorities listed in Annex B of the Convention.
  3. the term •·crypto-Asset Reporting Framework" means the international framework for the automatic exchange of information  with  respect to  Crypto-Assets  (which  includes  the Commentaries) developed by the OECD, with G20 countries.
  4. the term •·co-ordinating Body Secretariat'· means the OECD Secretariat that, pursuant to paragraph 3 of Article 24 of the Convention, provides support to the co-ordinating body that  is  composed of representatives of the  competent  authorities of the  Parties  to  the Convention.
  5. the term '·Agreement in effect" means, in  respect of any two Competent Authorities, that both  Competent  Authorities  have  provided  notification  to  the  Co-ordinating  Body Secretariat  under  paragraph  I  of  Section  7,  including  listing  the  other  Competent Authority's Jurisdiction pursuant to  subparagraph  lg) of Section 7.  A list of Competent Authorities between which this Agreement is  in  effect is  to  be published on  the OECD Website.
  1. Any capitalised term not otherwise defined in this Agreement will have the meaning that it has at that time under the law of the Jurisdiction applying the Agreement, such meaning being consistent with the meaning  set  forth  in  the  Crypto-Asset Reporting  Framework.  Any  term  not  otherwise defined  in  this Agreement or in  the Crypto-Asset Reporting Framework will, unless the context otherwise requires or the Competent Authorities agree to a common meaning (as permitted by domestic law), have the meaning that it  has  at  that  time under the  law  of the Jurisdiction  applying  this  Agreement,  any  meaning  under the applicable tax laws of that Jurisdiction prevailing over a meaning given to the term under other laws of that Jurisdiction.

SECTION 2

Exchange of Information with Respect to Reportable Persons

  1. Pursuant to the provisions of Article 6 and 22 of the amended or original Convention, as applicable,

and subject to the applicable reporting and due diligence rules consistent with the Crypto-Asset Reporting Framework, each Competent Authority will annually exchange with the other Competent Authorities on an automatic basis the information obtained pursuant to such rules and specified in paragraph 3.

  1. Notwithstanding paragraph  1,  the Competent Authorities of the Jurisdictions that have indicated that  they  are  to  be  listed  as  non-reciprocal jurisdictions  on  the  basis  of their  notification  pursuant  to subparagraph  I b)  of Section  7 will  send,  but  not  receive,  the  information  specified  in  paragraph  3. Jurisdictions that  are  not  listed as  non-reciprocal Jurisdictions will  receive the  information specified in paragraph 3, but will not send such information to the Jurisdictions included in  the aforementioned list of non-reciprocal Jurisdictions.

SECTION 2

Echange de renseignements concernant les Personnes devant faire I'objet d'une declaration

I.  Conformement aux dispositions des articles 6 et 22 de la Convention modifiee ou originale, scion le cas, et sous reserve des rcglcs applicahlcs en maticre de declaration et de diligence raisonnahle definies dans le  Cadre de declaration des Crypto-actifs, chaque Autorite competente echangcra chaquc annec avec les autrcs Autorites competcntes, de manicrc automatiquc, les rcnseignements ohtenus conformemcnt aces regles et precises dans le paragraphc 3.

  1.   1. The information to be exchanged is, with respect to each Reportable Person of another Jurisdiction:
  1. the name, address, jurisdiction(s) of residence, TIN(s) and date and place of birth (in the case of an  individual) of each Reportable User and, in  the case of any Entity that, after application  of  the  due  diligence  procedures,  is  identified  as  having  one  or  more Controlling  Persons  that  is  a Reportable Person,  the name,  address, jurisdiction(s)  of residence and TIN(s) of the Entity and the name, address, jurisdiction(s) of residence, TIN(s)  and  date  and  place of birth  of each  Controlling  Person  of the Entity that  is  a Reportable Person, as well as the role(s) by virtue of which each such Reportable Person is a Controlling Person of the Entity;
  2. the name, address and identifying number (if any) of the Reporting Crypto-Asset Service Provider;
  3. for each type of Relevant Crypto-Asset with respect to which the Reporting Crypto-Asset Service Provider has effectuated Relevant Transactions during the relevant calendar year or other appropriate reporting period:
  1. the full name of the type of Relevant Crypto-Asset;
  2. the aggregate gross amount paid, the aggregate number of units and the number of Relevant Transactions in respect of acquisitions against Fiat Currency;
  3. the  aggregate  gross  amount  received,  the  aggregate  number  of units  and  the number of Relevant Transactions in respect of disposals against Fiat Currency;
  4. the aggregate fair market value, the aggregate number of units and the number of Relevant Transactions in  respect of acquisitions against other Relevant Crypto- Assets;
  5. the aggregate fair market value, the aggregate number of units and the number of Relevant  Transactions  in  respect  of disposals  against  other  Relevant  Crypto- Assets;
  6. the aggregate fair market value, the aggregate number of units and the number of Reportable Retail Payment Transactions;
  7. the aggregate fair market value, the aggregate number of units and the number of Relevant Transactions,  and  subdivided  by  transfer  type  where  known  by  the Reporting  Crypto-Asset  Service  Provider,  in  respect  of  Transfers  to  the Reportable User not covered by subparagraphs c)(ii) and (iv);

viii)  the aggregate fair market value, the aggregate number of units and the number of

Relevant Transactions,  and  subdivided  by  transfer  type  where  known  by  the Reporting  Crypto-Asset  Service  Provider,  in  respect  of  Transfers  by  the Reportable User not covered by subparagraphs c)(iii), (v) and (vi); and

ix)  the aggregate fair market value, as well as the aggregate number of units in respect of Transfers by  the Reportable User effectuated by  the Reporting Crypto-Asset Service Provider to wallet addresses not known by  the Reporting Crypto-Asset Service Provider to be associated with a virtual asset service provider or financial institution.

3.  Les renseignements qui  doivent etre echanges, concernant chaque Personne devant  faire  l'objet d'une declaration d"une autre Juridiction, sont les suivants

  1. Le  nom,  l'adresse,  la  ou  les juridiction(s)  de  residence,  le  NIF,  la  date et  le  lieu  de naissance (pour une personne physique) de chaque Utilisateur soumis  a declaration et,

dans  le  cas  d'une Entite  pour laquelle,  apres  application  des  procedures de  diligence raisonnable, ii  appara1t qu'une ou plusieurs Personnes qui en detiennent le controle sont des  Personnes  devant  faire  l'objet  d'une  declaration,  le  nom,  l'adresse,  la  ou  les juridiction(s)  de  residence  et  le  NIF  de  cette  Entite  et  le  nom,  l'adresse,  la  ou  les juridiction(s) de residence,  le  NIF et  les  date et  lieu  de  naissance de chaque Personne detenant le controle de l'Entite qui est une Personne devant faire l'ohjet d'une declaration, ainsi que la ou  les fonction(s) au titre de la/desquelles chacune des Personnes devant faire r objet d • une dee laration est une Personne detenant le controle de r Entite ;

  1. Le nom, l'adresse et  le numero d'identification (eventuel) du  Prestataire de services sur Crypto-actifs declarant ;
  2. Pour chaque type de Crypto-actif concerne  pour  lequel  le  Prestataire de  services  sur Crypto-actifs declarant a effectue des Transactions concernees au cours de rannee civile consideree OU de toute autre periode de reference adequate
  1. Le nom complet du type de Crypto-actif conceme ;
  2. Le  montant  brut  total  acquitte,  le  nombre  total  d'unites  et  le  nombre  de Transactions concernees portant sur des acquisitions en contrepartie de Monnaies fiduciaires ;
  3. Le montant hrut total rec;u, le nombre total d"unites et le nombre de Transactions concernccs portant sur des cessions en contrcpartie de Monnaies fiduciaires ;
  4. La  justc  valcur  marchandc  totalc,  le  nomhre  total  d"unites  et  le  nomhre  de Transactions  conccrnees  portant  sur  des  acquisitions  en  contrepartie  d'autres Crypto-actifs concernes ;
  5. La  justc  valeur  marchande  totale,  le  nomhre  total  d'unites  et  le  nomhre  de Transactions concernees portant sur des cessions en contrepartie d'autres Crypto- actifs concernes ;
  6. La juste  valeur  marchande  totale,  le  nombre  total  d"unites  et  le  nomhre  des Transactions de paiement au detail declarahles ;
  7. La juste  valeur  marchande  totale,  le  nombre  total  d'unites  et  le  nombre  de Transactions  concernees  portant  sur  les  transferts  vers  l'Utilisateur  soumis  a

declaration non couvert par les alineas c)(ii) et (iv), reparties par type de transferl des lors que le  Prestataire de services sur Crypto-actifs declarant a connaissance de cette information ;

Time and Manner of Exchange of Information

  1. With respect to paragraph 3 of Section 2, and subject to the notification procedure set out in  Section

7, including the dates specified therein, information is to be exchanged commencing from the year specified in the notification pursuant to subparagraph 1 a) of Section 7 within nine months after the end of the calendar year to which the information relates. Notwithstanding the foregoing sentence, information is only required to be exchanged with respect to a calendar year if both Jurisdictions have legislation in place to give effect to the Crypto-Asset Reporting Framework that requires reporting with respect to such calendar year that is consistent  with  the  scope  of exchange  provided  for  in  Section  2 and  the  reporting  and  due  diligence procedures contained in  the Crypto-Asset Reporting Framework.

  1. The Competent Authorities will automatically exchange the information described in Section 2 in a common schema.
  2. The Competent Authorities will transmit the information through the OECD Common Transmission System and in  compliance with  the related encryption and  file preparation standards, or through another transmission method specified in  the notification pursuant to subparagraph 1 d) of Section 7.

SECTION 4

Collaboration on Compliance and Enforcement

A Competent Authority will  notify the other Competent Authority when  the  first-mentioned Competent Authority has reason to believe that an error may have led to incorrect or incomplete information reporting or there  is  non-compliance by  a Reporting Crypto-Asset Service Provider with  the  applicable reporting requirements and due diligence procedures consistent with the Crypto-Asset Reporting Framework. The notified Competent Authority will take all appropriate measures available under its domestic law to address the errors or non-compliance described in the notice.

SECTION 5 Confidentiality and Data Safeguards

  1. All information exchanged is  subject to the confidentiality rules and other safeguards provided for

in  the  amended  or  original  Convention,  as  applicable,  including  the  provisions  limiting  the  use  of the information exchanged and, to the extent needed to ensure the necessary level of protection of personal data, in accordance with the safeguards which may be specified by the supplying Competent Authority as required under its domestic law and as set out in the notification pursuant to subparagraph 1 e) of Section 7.

  1. A Competent Authority will notify the Co-ordinating Body Secretariat immediately regarding any breach  of confidentiality  or  failure  of safeguards  and  any  sanctions  and  remedial  actions consequently imposed. The Co-ordinating Body Secretariat will notify all Competent Authorities with respect to  which this is an Agreement in effect with the first mentioned Competent Authority.

Les  Autorites  competentes  transmettront  les  renseignements  par  l'intermediaire  du  Systeme commun de transmission de l'OCDE, et conformemcnt aux normes de cryptage et de preparation des fichiers afferentes,  ou  par  l'intermediaire  d'une  autre  methode  de  transmission  precisee  dans  la  notification

conformemcnt a l'alinea Id) de la section 7.

SECTION 4

Collaboration en matiere d'application et demise en reuvre

SECTION 5 Confidentialite et protection des donnees

I.  Tous  Jes  rcnscignemcnts  echanges  sont  soumis  aux  obligations  de  confidentialite  et  autres protections prevues par la Convention modifiee ou originale, selon le cas, y compris aux dispositions qui limitcnt !'utilisation des rcnseignements echanges et, dans la mesure ou cela est neccssaire pour garantir le dcgre requis de protection des donnees personnelles, conformement aux protections qui peuvent etrc cxigecs par I' Autorite competente qui communique les donnees en vertu de son droit intcrnc et specifiees dans la notification prevue par l'alinea le) de la section 7.

2.  Chaque Autorite competente notifiera immediatement au Secretariat de l'Organe de coordination toute violation de I' obligation de confidentialite ou des protections et I' informera de toute sanction et action corrective  qui  en  resultent.  Le  Secretariat  de  l'Organe  de coordination  informera  toutes  les  Autorites competentes pour lesquelles eel Accord a pris effet avec la premiere Autorite competcnte mentionnee.

Consultations and Amendments

I.  If any difficulties in  the  implementation or interpretation of this Agreement arise, a Competent Authority may request consultations with one or more of the Competent Authorities to develop appropriate measures to ensure that this Agreement is fulfilled. The Competent Authority that requested the consultations shall  ensure  that  the  Co-ordinating  Body  Secretariat  is  notified  of any  appropriate measures  that  were developed and the Co-ordinating Body Secretariat will notify all Competent Authorities, even those that did not participate in  the consultations, of any measures that were developed.

2.  This  Agreement  may  be  amended  by  consensus  by  written  agreement of all  of the  Competent Authorities. Unless otherwise agreed upon, such an  amendment is  effective on  the first day of the month following  the  expiration  of a period  of one  month  after the  date  of the  last  signature  of such  written agreement.

SECTION 7 General Terms

I.  A Competent Authority  must provide, at  the  time of signature of this Agreement or as  soon  as possible thereafter, notifications to the Co-ordinating Body Secretariat:

  1. confirming that its Jurisdiction has the necessary laws in place to give effect to the Crypto- Asset Reporting Framework and specifying the relevant effective dates, or any period of provisional application of the Agreement due to pending national legislative procedures (if any);
  2. confirming whether the Jurisdiction is to be listed as a non-reciprocal Jurisdiction;
  3. requesting consent from the other Competent Authorities to  use the information received for the assessment, collection or recovery of, the enforcement or prosecution in  respect of, or the determination of appeals in  relation to  taxes with respect to  which its Jurisdiction made a reservation pursuant to subparagraph  I (a) of Article 30 of the Convention and, if so, specifying these taxes and confirming that the use will be in  line with the terms of the Convention;
  4. specifying  one  or  more  alternative  methods,  if  any,  for  data  transmission  including encryption;
  5. specifying safeguards, if any, for the protection of personal data;
  6. confirming that it has in place adequate measures to ensure the required confidentiality and data safeguards standards are met; and
  7. a list of the Jurisdictions of the Competent Authorities with respect to  which it intends to have this Agreement in effect, following national legislative procedures for entry into force (if any).

Competent Authorities must notify the Co-ordinating Body Secretariat, promptly, of any subsequent change to he made to the above-mentioned notifications.

Consultations et modifications

I.  En  cas  de difficulte  dans  l'application  ou  l'interpretation  du  present  Accord,  chaque  Autorite competente peut solliciter des consultations avec une ou plusieurs Autorites competentes en vue d'elahorer des mesures appropriees pour garantir l'execution du present Accord. L' Autorite competente qui a sollicite les  consultations doit veiller a cc que  le  Secretariat de  l'Organe de coordination soit informe de toutes mesures appropriees ainsi elahorees, et le Secretariat de l'Organe de coordination informera l'ensemhlc des Autorites competentes, mcme celles qui n·ayant pas pris part aux consultations, de ces mesures.

2.  Le  present  Accord  peut  ctre  modifie,  par  consensus,  par  accord  ecrit  de  toutes  les  Autorites competentes. Sauf disposition contraire, une telle modification prend effet le premier jour du  mois suivant l'expiration d'une periode d'un mois apres la date de la derniere signature d'un tel accord ecrit.

SECTION7 Conditions generales

I.  Une Autorite competente doit, au moment de la signature du present Accord ou le plus tot possible par la suite, adresser une notification au Secretariat de l'Organe de coordination

a)  Confirmant que sa Juridiction a mis en place la  legislation necessaire pour donner effet au Cadre  de  declaration  des  Crypto-actifs  et  precisant  les  dates  d'entree  en  vigueur correspondantes,  ou  toute  periode  d'application  provisoire  de  l'Accord  en  raison  de procedures legislatives nationalcs (eventuelles) en cours ;

h)  Confirmant que la Juridiction doit figurer dans la  lisle des Juridictions pour lesquelles ii  n·y a pas de reciprocite ;

  1. Demandant aux  autres  Autorites competentcs  l'autorisation  d'utiliscr les  renseignements rec;us  aux  fins  de  l'etahlissement,  de  la  perception  ou  du  recouvrcmcnt  des  impots,  des procedures ou  poursuitcs penalcs concernant ccs impots ou  des decisions sur les rccours sc rapportant aces impfits, au titre desquels sa Juridiction a formule une reserve conformement a l'alinea  l(a) de  !'article 30 de  la  Convention et,  le  cas echeant, precisant ces impots et confirmant que ('utilisation sera conforme aux dispositions de la Convention ;
  2. Indiquant, le cas echeant, une ou plusieurs autres methodes de transmission electronique des donnees, y compris le cryptage ;
  3. Precisant, le cas echeant, les garanties applicables a la protection des donnees personnelles ;
  4. Confirmant qu'elle  a mis  en  place  les  mesures  adequates  pour assurer  la  confidentialite requise et le respect des normes de protection des donnees ; et
  5. Precisant  la  lisle  des  Juridictions  des  Autorites  competentes  a regard desquellcs  ellc  a !'intention que  le  present Accord prenne effet, conformement aux  procedures  legislatives nationales concernant l'entree en vigueur (le cas echeant).

Les Autorites competentes devront  notifier rapidement au  Secretariat de  l'Organe de coordination  toute modification ulterieure qu'elles comptent apporter aux notifications mentionnees ci-dessus.

  1. This Agreement will come into effect between two Competent Authorities on the date on which the second of the two Competent Authorities has provided notification to the Co-ordinating Body Secretariat under paragraph  I, of this Section, including listing the other Competent Authority's Jurisdiction pursuant to subparagraph I g) of this Section.
  2. The Co-ordinating Body Secretariat will maintain a list that will be published on the OECD website of the Competent Authorities that have signed the Agreement and between which Competent Authorities this is an Agreement in effect.
  3. The Co-ordinating Body Secretariat will publish on the OECD website the information provided by Competent Authorities pursuant to subparagraphs  la), b) and e) of this Section. The information provided pursuant to subparagraphs le), d), f) and g) of this Section will be made available to other signatories upon request in writing to the Co-ordinating Body Secretariat.
  4. A Competent Authority may suspend the exchange of information under this Agreement by giving notice in writing to another Competent Authority that it has determined that there is or has been significant noncompliance by the second-mentioned Competent Authority with this Agreement. Such suspension will have immediate effect. For the purposes of this paragraph, significant non-compliance includes, but is not limited to, non-compliance with the confidentiality and data safeguard provisions of this Agreement and the Convention, or a failure by the Competent Authority to provide timely or adequate information as required under this Agreement.
  5. A Competent Authority may  terminate its  participation  in  this Agreement, or  with  respect  to  a particular Competent  Authority,  by  giving  notice  of termination  in  writing  to  the  Co-ordinating  Body Secretariat. Unless specified otherwise by the Competent Authority, such termination will become effective on the first day of the month following the expiration of a period of 12  months after the date of the notice of termination.  In  the event of termination,  all  information  previously received under this  Agreement will remain confidential and subject to the terms of the Convention.

SECTION 8 Co-ordinating Body Secretariat

Unless  otherwise  provided  for  in  the  Agreement,  the  Co-ordinating  Body  Secretariat  will  notify  all Competent Authorities of any  notifications that  it  has received under this Agreement and will  provide a notice to all signatories of the Agreement when a new Competent Authority signs the Agreement.

Done in English and French, both texts being equally authentic.

  1. Le present Accord prendra effet entre deux Autorites competentes a la date a laquelle la  seconde des deux Autorites competentes aura adresse au Secretariat de l'Organe de coordination la notification visee au paragraphe  I de la  presente section, chaque Autorite competente ayant inscrit la  Juridiction de l'autre Autorite competente sur la liste conformement a l'alinea lg) de la presente section.
  2. Le Secretariat de l'Organe de coordination conservera et publiera sur le site web de l'OCDE une liste des Autorites competentes qui ont signe !'Accord et entre lesquelles le present Accord a pris effet.
  3. Le Secretariat de l'Organe de coordination publiera sur le site web de l'OCDE les renseignements fournis par les Autorites competentes conformement aux  alineas  la), b) et e) de la  presente section. Les renseignements fournis conformement aux alineas  I c), d), f) et g)  de  la  presente section seront mis a la disposition des autres signataires sur demande ecrite adressee au Secretariat de l'Organe de coordination.
  4. Une Autorite competente peut suspendre l'echange de renseignements vise par le present Accord moyennant preavis ecrit adresse a une autre Autorite competente indiquant que cette derniere commet OU  a commis un manquement grave au present Accord. Cette suspension est a effet immediat. Aux fins du present paragraphe, l'expression « manquement grave» designe notamment le non-respect des dispositions relatives l1 la  confidentialite et  a la  protection des donnees du  present Accord et  de la  Convention ou  le  fait pour I' Autorite competente de ne pas communiquer des informations appropriees ou en temps voulu comme le prevoit le present Accord.
  5. Une Autorite competente peut mettre fin  a sa participation au present Accord ou  vis-a-vis d'une autre Autorite competente moyennant un  preavis ecrit adresse au Secretariat de l'Organe de coordination. Saur indication contraire de I' Autorite competente, cette denonciation prend effet le  premier jour du  mois suivant !'expiration d'un delai de douze mois a compter de la date du preavis. En cas de denonciation, toutes Jes informations deja re ues  au titre du  present Accord restent rnnfidenticlles et soumises aux dispositions de la Convention.

SECTION 8

Secretariat de  l'Organe de  coordination

Saur disposition contraire contenue dans  I' Accord,  le  Secretariat de l'Organe de coordination  informera l'ensemhle des Autorites competentes de toute notification qu"il re oit  au titre du present Accord et donnera notification  a tous  Jes  signataires  de  I' Accord  de  la  signature  de  I' Accord  par  une  nouvelle  Autorite competente.
