REPORT

On 20th November 2025 the Minister for Sustainable Economic Development made a Ministerial Decision delegating certain of his functions under Articles 28, 30 and 30A of the States of Jersey Law 2005 (see Decision reference MD-SED-2025-827, available at www.gov.je).

The terms of the delegations, and the legislation under which those delegations were made, were recorded in a Report attached to the Ministerial Decision, as shown below –

Delegation of Functions: Shipping (Fishing Vessel Safety Codes of Practice)(Jersey) Regulations 2015

When the delegation of shipping functions for the Minister for Sustainable Economic Development were updated in 2020, the Shipping (Fishing Vessels Safety Provisions) (Jersey) Order 2004, which (via the delegation of functions) provided the Registrar of Shipping with the delegation to issue or cancel fishing vessel certificates, was not updated to reflect the newest iteration (Shipping (Fishing Vessel Safety Codes of Practice)(Jersey) Regulations 2015. This means the Registrar is currently unable to fulfil functions previously held relating to fishing vessels certification.

Providing this delegation will correct the mistake of the delegation not being renewed following the introduction of the new 2015 code, and will ensure the Registry is empowered to act appropriately when certification functions are required, complimenting the overall suite of shipping delegations issued to the Registrar.

By virtue of the functions and powers vested in me under Shipping (Fishing Vessel Safety Codes of Practice)(Jersey) Regulations 2015, I hereby delegate the following functions to the Chief Marine Surveyor, Head of External Maritime Compliance (Ports of Jersey), Registrar of Shipping and Assistant Registrar of Shipping.

Limit on scope of delegation:	Scope of this delegation is limited to the parameters detailed in Regulation 3 (2), (3), (4) of the Shipping (Fishing Vessel Safety Codes of Practice)(Jersey) Regulations 2015.
Functions delegated	The following functions and powers under Regulation 3 of the Shipping (Fishing Vessel Safety Codes of Practice)(Jersey) Regulations 2015 are delegated to the Chief Marine Surveyor, Head of External Maritime Compliance (Ports of Jersey), Registrar of Shipping and Assistant Registrar of Shipping until rescinded. The power to:

Grant, on such terms as may be specified, an exemption for an individual fishing vessel from a specified requirement of the Code which would otherwise apply in relation to that fishing vessel by virtue of these Regulations.
Extend the period of validity of a certificate of compliance, or an exemption granted under these regulations, on such terms as may be specified.
Accept as evidence a certificate which demonstrates that a fishing vessel complies with requirements as to safety which are equivalent to, or more stringent than, those in the Code, and is in force in relation to the fishing vessel in question.
