REPORT
Purpose of Report
To enable the Minister to approve the allocation of up to £455,000 from the Criminal Offences Confiscation Fund (COCF) to the States of Jersey Police and Firearms Range Project Heads of Expenditure.
Background
The COCF holds balances awarded from the confiscation of proceeds of crime. The Fund is then able to use these awarded receipts to provide funds towards activities to meet ongoing criminal activities, or the legal implications of investigations.
As a result of the States of Jersey Police investigations into the Major Incidents which occurred in late 2022, a substantial amount of evidence has been gathered that needs to be retained and archived in digital format. A small amount of existing budget has been requested to be repurposed to fund the IT investment, with a balance remaining to be funded. The States of Jersey Police are requesting for the balancing amount of £175,000 from the COCF.
The States of Jersey Police have also completed their new Firearms Range. Based on the final costs of the project, a further amount of up to £280,000 is requested from the COCF to the project Head of Expenditure.
The Attorney General has been consulted on the use of the funds.
It is recommended to the Minister for Treasury and Resources, authorise the use of COCF balances for these requests.
Recommendation
The Minister is recommended to approve the allocation of up to £455,000 to the States of Jersey Police and Firearms Range Project Heads of Expenditure.
Reasons for Decision
Article 21 of the Public Finances (Jersey) Law 2019 states that if, during a financial year, the Minister is satisfied that the income of a States funded body or area of operation is likely to exceed the estimate income for that income, the Minister may authorise the withdrawal of that excess amount from the Consolidated Fund during that year.
A case for funding from the COCF has been made by the department, and the Attorney General has been consulted, Following review by the Investment Appraisal team, the Treasurer of the States is now recommending this to the Minister for Treasury and Resources for approval.
Resource Implications
In 2025, the COCF will decrease by up to £455,000.
The income and expenditure of the States of Jersey Police and the Firearms Range project Heads of Expenditure will increase by £175,000 and £280,000 respectively.
