REPORT
Decision(s): Under Article 18(4) of the Public Finances (Jersey) Law 2019 (the Law), the Minister for Treasury and Resources hereby notifies the States, and having consulted with any relevant Minister under Article 18(5) of the Law; that she has agreed to the following –

After the expiry of 4 weeks following the presentation to the States of these transfers, the Minister hereby authorises the Treasurer of the States to action the transfers outlined in the table above.
- Purpose of Report
To enable the Minister to approve the recurring budget transfer from the Education and Lifelong Learning (ELL) head of expenditure to the Economic Development, Tourism, Sport and Culture (EDTSC) head of expenditure to reflect the transfer for responsibility for the Jèrriais service.
- Background
The Jèrriais Service provides educational and cultural activities with the aim of conserving and promoting the language and associated traditions.
The Jèrriais budget of £670,000 counts in the Arts, Culture and Heritage 1% as agreed by the Assembly but has from the outset been the responsibility of the Minister for Education as the majority activity was original deemed to be teaching in schools. There are 5 posts associated with it being one leadership role and 4 teaching posts. Over time, the promotional and cultural elements of the work have increased compared with time spent teaching in schools.
The Minister of Education and Lifelong Learning (MELL) and the Minister for Sustainable Economic Development (MSED) have agreed that the future of Jèrriais will be best served by transferring responsibility for the service to the MSED, who also holds the portfolio for culture and oversees the delivery of the Assembly's commitment to Arts, Culture and Heritage.

Financial responsibility for the whole service will transfer to EDTSC whilst ELL will retain oversight of the teachers deployed in schools.
- Recommendation
The Minister is recommended to approve the recurring budget transfer from ELL to EDTSC to reflect the change in accountability for delivering the policy intent for the Jèrriais Service.
- Reason for Decision
Article 18(1)(a) of the Public Finances (Jersey) Law 2019 states that a specified amount appropriated for one head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure that is set out in the government plan.
Article 18(4) of the Public Finances (Jersey) Law 2019 states that the Minister shall give the States Assembly at least 4 weeks' notice before an amount is transferred under paragraph (1)(a).
Article 18(5) of the Public Finances (Jersey) Law 2019 states that if a direction under this Article would affect a head of expenditure that relates to the responsibilities of any Minister, that Minister must be consulted before the direction is made. The applicable Ministers have been consulted.
- Resource Implications
The ELL head of expenditure will decrease by £670,000 with effect from 1 January 2026 along with associated expenditure and the EDTSC head of expenditure will increase by an identical amount.
This decision does not change the total amount of expenditure approved by the States in the Budget for 2026-29.
