COMMENTS

Deputy Kovacs has proposed that the Privileges and Procedures Committee (PPC) review the Standing Orders of the States of Jesey in relation to breaches of the Code of Conduct for Elected States Members and the sanctions that may be applied in such instances – including, but not limited to, disqualification mechanisms and suspension. The  report  accompanying  the  proposition  makes  it  clear  that,  amongst  any  such "disqualification mechanisms", PPC should look at the question of recall elections.

PPC is prepared to accept the amendment as this is work on which the Committee has, in fact, already embarked. The Committee has begun to consider the existing provisions within Standing Orders in relation to sanctions for breaching the Code of Conduct as well as the provisions of the States of Jersey Law 2005 in respect of disqualification from office.

The   Deputy 's  proposition  envisages  that  the  review  of  Standing  Orders  will  be completed in time for a report to be presented to the States before 31st December 2026. Whilst PPC will endeavour to make progress within the current term, it is possible that this work will straddle two Assemblies and two PPCs; the current Committee cannot therefore predict what findings its successor may reach.

Deputy Scott has lodged an amendment that, if adopted, would increase the scope of the review proposed by Deputy Kovacs to include consideration of the procedures for handling complaints and for the disclosure of personal details in that process. This is a matter which the Deputy has previously spoken to the Committee about and which the Committee has also already begun to consider.
