COMMENTS

Background

The Draft Limited Partnerships (Jersey) Amendment Law 202- [P.108/2025] (hereafter referred to as "draft Law") was lodged au Greffe on 26th November 2025 by the Minster for External Relations (hereafter referred to as "the Minister") and is scheduled for debate at the States' sitting commencing on 20th January 2026.

The Economic and International Affairs Scrutiny Panel (hereafter referred to as "the Panel") received a briefing on the proposed draft Law on 16th December 2025 as well as previous communications and updates received from the Minister.

The purpose of the draft Law as stated within the proposition is to "put on to a statutory footing the framework for enabling eligible foreign limited partnerships to continue as limited partnerships in Jersey. In consequence, the Limited Partnerships (Continuance) (Jersey) Regulations 2023 will be repealed."1

Mindful of the importance of appropriate consultation and how these proposed changes have been received by industry, the Panel explored this aspect with the Minster. The Minister explained that work to inform these amendments to the draft law had been in progress since 2023 with the proposed amendments reviewed by an industry working group and the Jersey Financial Services Commission (JFSC) for final comments before the law drafting process to finalise the draft Law for lodging.

Through its questioning, the Panel understands that the Minister remains mindful of how peer jurisdictions operate and is working to meet the requirements set by the Financial Action Task Force (FATF), as part of a broader effort to ensure Jersey remains an attractive destination for prospective Limited Partnerships.

Conclusion

The Panel welcomes the initiative to incorporate existing regulations into primary legislation, strengthening the island's competitiveness and aligning Jersey with other international finance centres that offer comparable continuance regimes. Accordingly, the Panel supports the draft Law and its objectives.
