Standing Order 55A – remote participation

THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with members able to participate remotely using Microsoft Teams.

THE  STATES  resumed  consideration  of  a  proposition  of   Deputy  Sir  Philip  Martin   Bailhache  of St. Clement entitled Vote of No Confidence: Chair of the Health and Social Security Scrutiny Panel' (P.7/2023) and, adopting the proposition, agreed that they had no confidence in the Chair of the Health and Social Security Scrutiny Panel.

Establishment of a Climate Council P.117/2022

THE STATES commenced consideration of a proposition of the Minister for the Environment entitled Establishment of a Climate Council' (P.117/2022) and, adopting paragraph (b) of an amendment of Deputy Thomas Antony Coles of St. Helier South (P.117.2022 Amd.), agreed that, after the words "set out in the Report", there should be inserted the words ", except that on page 4, after the words "States Assembly.", there should be inserted the words "The Council will consider and advise on  Carbon Sequestrating initiatives that would be applicable to Jersey.""

THE STATES, resuming consideration of the proposition of the Minister for the Environment, as amended, rejected paragraph (a) of the amendment of Deputy Thomas Antony Coles of St. Helier South that, after the words "set out in the Report", there should be inserted the words ", except that the delivery phase for the Climate Council should be 2 years instead of 4 years, with all references to the 4-year delivery phase amended accordingly".

THE STATES, adopting the proposition of the Minister for the Environment, as amended, approved, in accordance with the amendment made by the Environment, Housing and Infrastructure Scrutiny Panel to the Carbon Neutral Roadmap, agreed on 29th April 2022, the establishment of a Climate Council for Jersey with terms of reference and membership as set out in the Report, except that on page 4, after the words "States Assembly." there should be inserted the words "The Council will consider and advise on Carbon Sequestrating initiatives that would be applicable to Jersey."

Trainee Minimum Wage P.5/2023

THE STATES commenced consideration of a proposition of Deputy Max Brennan Andrews of St. Helier North entitled Trainee Minimum Wage' (P.5/2023) and, adopting an amendment of the Minister for Social Security, agreed that, for the words "integrated into a single minimum wage rate" there should be substituted the words "harmonised with the main minimum wage rate, by way of Ministerial Order,".

THE STATES, adopting the proposition of Deputy Max Brennan Andrews of St. Helier North, as amended, agreed that the trainee minimum wage rates should be harmonised with the main minimum wage rate, by way of Ministerial Order, for all employees of school leaving age and above, no later than 1st January 2024, pursuant to the Jersey Employment Forum's  recommendations  published on 8th September 2022.

Assembly consideration of the Bilateral Treaty with the UAE P.6/2023

THE STATES commenced consideration of a proposition of Deputy Samuel Yves Mézec of St. Helier South entitled Assembly consideration of the Bilateral Treaty with the UAE' (P.6/2023) and, adopting an amendment of the Minister for External Relations and Financial Services (P.6/2023 Amd.(2)), agreed that, in paragraph (a), after the words "to take the necessary" there should be inserted the word "final"; for the word "ensure" there should be substituted the word "bring"; the words "does not come" should be deleted; and for the words "until such time as the Treaty has been considered by the States Assembly" there should be substituted the words "as soon as possible".

THE STATES resumed consideration of the proposition of Deputy Samuel Yves Mézec of St. Helier South , as amended, and, adopting an amendment of Deputy Sir Philip Martin Bailhache of St. Clement (P.6/2023 Amd.), agreed that, in paragraph (b) –

  1. for  the  words  "Council  of  Ministers"  there  should  be  substituted  the  words  "Legislation Advisory Panel";
  2. for the words "a process" there should be substituted the word "legislation";
  3. the words "Bilateral Investment" should be deleted;
  4. after the word "Treaties" there should be inserted the words "and International Agreements signed  by  a  Minister  under  entrustment  from  the  United  Kingdom  Government  or  to  be extended to Jersey under the United Kingdom's ratification process"; and
  5. for the words "full consultation with, and approval"  there should be substituted the word "ratification".

THE STATES resumed consideration of the proposition of Deputy Samuel Yves Mézec of St. Helier South ,  as  amended,  and adopting paragraph (a), requested the  Minister for External Relations  and Financial Services to take the necessary final steps to bring the Bilateral Investment Treaty with the United Arab Emirates into force as soon as possible.

THE STATES, adopting paragraph (b) of the proposition of Deputy Samuel Yves Mézec of St. Helier South , as amended, requested the Legislation Advisory Panel, in consultation with the Privileges and Procedures Committee, to bring forward legislation by which all Treaties and International Agreements signed by a Minister under entrustment from the United Kingdom Government or to be extended to Jersey under the United Kingdom Government's ratification process, were subject to ratification by the States Assembly before they came into force.
