P.101/2025 – A1. The Committee, with reference to its Minute No. A8 of 10th November 2025, Breaches of considered a draft comment which had been prepared in response to P.101/2025 – the Code of Breaches of the Code of Conduct – review of Standing Orders, which had been Conduct: lodged ‘au Greffe’ by Deputy R.S. Kovacs of St. Saviour on 4th November 2025. review of
Standing The Committee noted that the aforementioned proposition requested the Committee Orders. to review Standing Orders in relation to breaches of the Code of Conduct, to include
consideration of disqualification mechanisms and varying lengths of suspension (paid and unpaid) and to present a report to the States no later than 31st December 2026 with its findings and recommendations.
The Committee recalled that, following extensive work on revisions to the Code of Conduct for Elected Members, it had lodged ‘au Greffe’ a proposition on 11th November 2025, which sought to replace the Code (P.102/2025 refers) with a rules- based version with accompanying guidance.
It was noted that the draft comment confirmed the Committee’s acceptance of Deputy Kovacs ’ proposition on the basis that work had already commenced in relation to a review of sanctions for breaches of the Code and the provisions of the States of Jersey Law 2005 in respect of disqualification from office. It was noted that the Deputy ’s proposition envisaged the presentation of a report on the matter before 31st December 2026. It was acknowledged that whilst every effort would be made to complete the review during the life of the current Assembly, it was possible that the review might have to be progressed by the Committee’s successor, whose conclusions could not be predicted.
The Committee approved the draft comment and requested that it be presented to the States.
