THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), Members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with Members able to participate remotely using Microsoft Teams. THE STATES noted that the Minister for the Environment had informed the Greffier, in accordance with Standing Order 30(2), that his proposition entitled Draft Sea Fisheries (Minimum Size Limits) (Jersey) Amendment Regulations 202-' (P.53/2025) would be deferred from the present meeting to 30th September 2025.

THE STATES noted that, in accordance with Standing Order 34(1), Deputy Sir Philip Martin Bailhache of St. Clement of St. Clement had informed the Greffier of the States that his amendment (P.58/2025 Amd.) to the proposition of the Chief Minister entitled Extension of Section 75 (Electronic Travel Authorisations) of the Nationality and Borders Act 2022 to Jersey (P.58/2025) had been withdrawn.

THE STATES, adopting a proposition of the Chair of the Privileges and Procedures Committee, agreed that the Assembly would continue to meet until 8.00 p.m. that and on Friday 12th September 2025, if required, with an adjournment to take place each day between 5.30 p.m. and 6.00 p.m.

THE STATES, resuming consideration of the Draft Residential Tenancy (Jersey) Amendment Law 202-, resumed consideration of Articles 1 to 26, as amended, and, adopting Part 6 of an amendment of the Environment, Housing and Infrastructure Scrutiny Panel (P.24/2025 Amd.(4)), agreed that, in Article 6, new Part 3, the new Article 7 should be deleted.

THE STATES resumed consideration of Articles 1 to 26, as amended and, adopting Parts 7, 8, 10, 11(2) and 11(5) of the amendment of the Environment, Housing and Infrastructure Scrutiny Panel (P.24/2025 Amd.(4)), agreed that –

in Article 6, new Part 3A, new Article 7D(4), for "If this paragraph is applied by Order" there should be substituted "If this paragraph is applied by Regulations";

in Article 11, new Part 4A, new Article 13B(4)(e), for "unless this requirement is excluded by Order" there should be substituted "unless this requirement is excluded by Regulations";

in Article 18(2), the new Article 23(2)(la) and (ld) should be deleted and the remaining new sub- paragraphs and cross-references should be renumbered accordingly;

in Article 19 –

(2)  In Article 19(1), after the new Article 24(1)(lc) there should be inserted –

"(ld) applying Article 7D(4) (so that certain exceptions to the limit on rent increases are

determined by the Rent Tribunal);

(le) excluding the requirement in Article 13B(4)(e) (for the chair and the deputy chair of the

Tribunal to have a qualification in law);" and

(5)  The subsequent paragraph of Article 19 should be renumbered accordingly.

THE STATES noted that, following the adoption of the amendment of Deputy Jonathan Renouf of St. Brelade  (P.24/2025  Amd.(3)),  Part  11(1)  12  of  the  amendment  of  Environment,  Housing  and Infrastructure Scrutiny Panel (P.24/2025 Amd.(4)) to the Draft Residential Tenancy (Jersey) Amendment Law 202- was deemed to have been withdrawn.

THE STATES resumed consideration of Articles 1 to 26, as amended and, adopting a proposition of the Minister for Housing, agreed, in accordance with Standing Order 87, to defer consideration of the Articles until a consolidated version of the Residential Tenancy (Jersey) Law 2011 was provided to members.

THE STATES noted that the Presiding Officer, in accordance with Standing Order 75(4), had granted permission  for  a  clerical  error  within  the  draft  to  be  amended,  namely  that,  in  Regulation  6,  in paragraph 1(b), the word "in" should be inserted before the words "a civil partnership".

THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Articles 1 to 65 and rejected an amendment of the Connétable of St. Helier (P.56/2025 Amd.), that –

in Article 3 –

THE STATES noted that, as the amendment of the Connétable of St. Helier had not been supported by a majority of the elected members of which the States were constituted, the matter had been determined in the negative in accordance with Standing Order 89A.

THE STATES, resuming consideration of Articles 1 to 65, rejected an amendment of Deputy Montfort Tadier of St. Brelade (P.24/2025 Amd.(4)) that –

in Article 9, in the inserted Article 6B(1), for "7 June 2026" there should be substituted "3 May 2026"; in Article 10, for the inserted Article 6C there should be substituted –

"6C Ordinary elections for Senators and Deputies: 2030 onwards

  1. An ordinary election for Senators is to be held in 2030.
  1. After 2030, a subsequent ordinary election for Senators is to be held in the fourth calendar year (an "election year") following that in which the previous ordinary election was held.
  2. An ordinary election for Deputies is to be held in 2030.
  3. After 2030, a subsequent ordinary election for Deputies is to be held in each election year.
  4. The States –
  1. may by Act appoint the date in 2030, and in each subsequent election year, on which –
    1. the ordinary election for Senators is to be held; and
    2. the ordinary election for Deputies is to be held;
  2. must not appoint a date under sub-paragraph (a) that would result in an ordinary election for Deputies, in 2030 or a subsequent election year, being held on or before the date on which an ordinary election for Senators is to be held in that year.";

in Article 17 –

  1. Paragraph  (2)  should  be  deleted  and  the  subsequent  paragraph  should  be  renumbered accordingly; and
  2. In paragraph (3) (renumbered as paragraph (2)), for "for Senators, Deputies or Connétable s" there should be substituted "for Senators or Deputies under this Law, or for Connétable s under Article 2 of the Connétable s (Jersey) Law 2008";

in Article 32 –

"(2AA) In the case of an order in respect of a public election, paragraph (2)(a) does not apply if the date of the public election has been appointed by the States by Act under –

  1. Article 6C of the States of Jersey Law 2005 (ordinary elections for Senators and Deputies: 2030 onwards); or
  2. Article  2  of  the   Connétable s  (Jersey)  Law  2008  (ordinary  elections  for Connétable s).

(2AAA) If paragraph (2)(a) applies in relation to an election required under Article 6C of

the States of Jersey Law 2005, the Royal Court must not fix a date that would result in an ordinary election for Deputies in a particular year being held on or before the date on which an ordinary election for Senators is held in that year.

(2AAB) If the order is made in respect of an ordinary election for Senators, held in a

particular year under Article 6C of the States of Jersey Law 2005, the date fixed under paragraph (2)(c) must be within the period of 14 days beginning with the day of the ordinary election for Deputies held in that year under that Article.

(2AAC) If an order is made in respect of an ordinary election for Deputies under Article 6C

of the States of Jersey Law 2005, or for Connétable s under Article 2 of the Connétable s (Jersey) Law 2008, the date fixed under paragraph (2)(c) must be –

  1. as early as reasonably practicable; and
  2. in any event, within the period of 14 days beginning with the day of the election.";

in Article 33, in the inserted Article 17AA –

  1. for paragraph (2)(b) there should be substituted –

"(b) the date fixed –

  1. must be at least 38 days after the day on which the order is made; and
  2. must not result in the election being held on or before the date on which an ordinary election for Senators is held in 2026.
  1. in paragraph (3), after sub-paragraph (a) there should be inserted – "(b) paragraphs (2AAB) and (2AAC);"
  2. the subsequent sub-paragraph should be renumbered accordingly; and
  3. paragraph (4) should be deleted and the subsequent paragraph should be renumbered accordingly;

in Article 36, in the inserted Article 17BA –

  1. in paragraph (1), after "This Part" there should be inserted ", except Article 17I,";
  2. after paragraph (2) there should be inserted –

"(3) Article 17I does not apply in relation to a public election held in 2026 for Connétable s under

Article 2 of the Connétable s (Jersey) Law 2008;"; and

  1. the subsequent paragraph should be renumbered accordingly; in Article 36 –
  1. after Article 36 there should be inserted –

"37 Article 17C (nomination of a candidate) amended

In Article 17C(3)(a), for "at least 6 weeks before, but no more than 7 weeks before" there is substituted "at least 25 days before, but no more than 30 days before"."; and

  1. the subsequent Articles and cross-references (including those in Article 65, renumbered as Article

66) should be renumbered accordingly;

    2. ending with the day on which election is held.
  3. This Article is deleted at the end of 31 December 2026."; and

(b)  the subsequent paragraph should be renumbered accordingly; and in Article 65 (renumbered as Article 66) –

Extension of Section 75 (Electronic Travel Authorisations) of the Nationality and Borders Act 2022 to Jersey P.58/2025

THE STATES, adopting a proposition of the Chief Minister entitled Extension of Section 75 (Electronic Travel Authorisations) of the Nationality and Borders Act 2022 to Jersey' (P.58/2025) agreed, pursuant to Article 31 of the States of Jersey Law 2005 that a request would be made to His Majesty in Council for the making of an Order In Council to extend, with appropriate modifications, section 75 of the Nationality and Borders Act 2022 to Jersey; and agreed to the proposed Order in Council entitled "The Immigration (Electronic Travel Authorisation) (Jersey) Order 2025.
