The Sub-Committee received and considered draft comments, which had been Children as prepared in response to the proposition entitled Treating Children as Children' Children (P.14/2026), which had been lodged au Greffe' by Deputy Sir. P.M. Bailhache of St. (P.14/2026): Clement on 26th January 2026.

The Sub-Committee noted that the proposition requested that the Minister for Education and Lifelong Learning replace the existing Trans Inclusion Guidance, (Non-statutory guidance for Children, Young People, Education and Skills (CYPES) including schools and educational settings in Jersey) with a document entitled Treating children as children: a safeguarding approach to trans-identifying children and adolescents in Jersey schools', which had been drafted by Ms. S. Davies-Arai. Deputy Bailhache 's proposition, which was due to be debated by the States Assembly on 24th February 2026, argued that the existing guidance was influenced by a flawed and misapplied equality and inclusion agenda which prejudiced the safeguarding of children in general.
The Sub-Committee did not support replacing the existing Trans Inclusion guidance in schools as suggested on the basis that it was considered reasonable and evidence based. The Sub-Committee was committed to improving diversity and inclusion in Jersey and the proposition conflicted with these principles. Consequently, the draft comment urged Members to reject the proposition.
Having considered the comment, the Sub-Committee approved the same and requested that the Privileges and Procedures Committee (PPC) consider presenting the comment on its behalf on the basis that Standing Orders precluded the Sub-Committee
