THE STATES, with reference to their Act dated 14th September 2021, in which they had agreed that, notwithstanding Standing Order 55A(1), Members who did not wish to attend in the States Chamber might continue to take part in States meetings using Microsoft Teams (until the States had considered and voted upon a proposition to re-apply Standing Order 55A(1) or to repeal or vary the terms of the Standing Order), assembled in accordance with Standing Order 55A with Members able to participate remotely using Microsoft Teams. THE STATES, adopting a proposition of Deputy David James Warr of St. Helier South , agreed, in accordance with Standing Order 80, to suspend Standing Order 32 in order that his proposition entitled Deferral of Land Transaction Philip Le Feuvre House and Huguenot House' (P.59/2026), might be listed for consideration at the present meeting; and further agreed in accordance with Standing Order 26(7), to reduce the minimum lodging period in respect of the same proposition in order that it might be debated at the present meeting.

THE STATES noted that, in accordance with Standing Order 34(1), the Minister for Infrastructure had informed the Greffier of the States that the Draft Road Traffic Law (Drug Driving) (Jersey) Amendment Regulations 202- (P.32/2026) had been withdrawn.

Draft Animal Welfare (Jersey) Law 202- P.97/2025

THE STATES resumed consideration of the Draft Animal Welfare (Jersey) Law 202-, the principles having been adopted on 22nd January 2026, and, commencing consideration of Articles 1 to 41, adopted the amendment of the Minister for the Environment (P.97/2025 Amd.), that in Article 40 –

(a)  after paragraph (1), there should be inserted –

"(2) In Article 1 of the Dogs (Jersey) Law 1961, for the definition "animal shelter" there is

substituted –

"animal shelter" means a place (including a private dwelling) that regularly receives, for the purpose  of temporary or permanent accommodation with or without the provision of treatment –

  1. abandoned animals;
  2. animals separated from their keeper for any reason; or
  3. animals previously living wild in Jersey that have been captured because they are injured or sick;" and

(b)  the subsequent paragraphs should be renumbered accordingly.

THE STATES resumed consideration of Articles 1 to 41, as amended and rejected Parts 1, 3 and 4 of the amendment of the Environment, Housing and Infrastructure Scrutiny Panel (P.97/2025 Amd.(3)), that –

in Article 1 –

(a)  for the definition "animal welfare legislation" there should be substituted – "animal welfare legislation" means –

  1. this Law and Regulations and Orders made under this Law; and
  2. Regulations  or  Orders  dealing  with  animal  welfare  made  under  the  European  Union Legislation (Implementation) (Jersey) Law 2014;

(b) after the definition "premises" there should be inserted – "restricted procedure" is defined in Article 7(4) and (5);

in Article 18 –

  1. for paragraph (1) there should be substituted –

"(1) The States may by Regulations specify activities relating to animal welfare that must not

be carried out without a licence.

  1. Regulations under paragraph (1) must not specify an activity that is –
    1. a restricted procedure;
    2. authorised under Regulations or Orders dealing with animal welfare made under the European Union Legislation (Implementation) (Jersey) Law 2014.
  2. The Minister may by Order make provision for a licensing system for the grant of a licence required by Regulations under paragraph (1), including –
  1. the procedure for –
    1. applying for a licence;
    2. amending or varying a licence;
    3. revoking or suspending a licence;
    4. appealing a decision made in relation to a licence;
  2. the conditions of the licence;
  3. any fee payable in relation to the licence." And

(2)  the subsequent paragraph should be renumbered accordingly; and in Article 34 –

  1. after paragraph (2) there should be inserted –

"(3) An Order must not specify activities relating to animal welfare that must not be carried

out without a licence"; and

  1. the subsequent paragraphs should be renumbered accordingly.
