Matters of Privilege

Deputy Montfort Tadier of St. Brelade raised a matter of privilege concerning an email issued to States Members by the Chief Executive's Office regarding public comments on ongoing court proceedings. The Bailiff ruled the following:

"I  am  grateful  to   Deputy   Tadier  for  raising  this  matter.  Although  the  email  in  question  was undoubtedly sent in good faith and motivated by sincere reasons, it should not have been sent. It is not appropriate for a civil servant acting on behalf of the executive to tell Members how to conduct themselves in this context. Members are well able to understand their duties and obligations in respect of criminal trials and, indeed in the case of new Members, have been recently asked to consider such matters in the course of their induction. Any messaging thought necessary on the part of Ministers could have been delivered with a different tone, certainly a less directive tone, and potentially by an elected Member from within Government. Parliamentary privilege is enshrined in statute; see Articles 34 and 35A of the States of Jersey Law. Nonetheless, I do not think this intervention in fact affects the privileges or immunity of the States. The email, while inappropriate, could not itself affect or limit Members' freedom of speech whether within or without the Chamber. It is for the Assembly alone to determine its own rules as part of parliamentary privilege. Members themselves have made Standing Orders governing their own conduct, which provide, for example, at Standing Order 107, a power to prevent Members from referring to matters relevant to proceedings in any court, and a duty under Standing Order 104 not to refer to a case pending in court in a way which might prejudice that case. Outside the States, what Members say is a matter for themselves, subject to the law on contempt of court and the Code of Conduct for Elected Members. The contents of the email in question did, in effect, no more than allude to these rules, but to be sent in the terms it was unnecessary and perhaps high-handed."
