Control of Housing and Work (Fees) (Jersey) Amendment Order 2025. Chief Minister.
This Order amends the Control of Housing and Work (Fees) (Jersey) Order 2013 to increase the fees payable under that Order by 2.5%. The fees were last increased from 1st January 2025.
The Order was made on 14th November 2025 and comes into force on 1st January 2026.
Regulation of Care (2026 Fees) (Jersey) Amendment Order 2025. Minister for the Environment.
This Order amends the Regulation of Care (Fees) (Jersey) Order 2022.
The amendments increase by 2.5% –
• the fee payable for an application for registration as a provider or manager of a regulated activity;
• the annual fee payable by a registered provider of a regulated activity;
• the fee payable for a copy of an entry in the register of registered persons;
• the fee payable for the issue of a replacement certificate to a registered provider;
• the surcharge payable for non-payment of an annual fee by the deadline (31st January); and
• the fee payable for an application to vary or remove a condition.
The amendments come into force on 1st January 2026.
The fees and surcharge were last increased on 1st January 2025.
The Order was made on 17th November 2025 and comes into force on 1st January 2026.
Children Rules 2025.
Superior Number of the Royal Court.
The Children Rules 2025, if made, will replace the Children Rules 2005 in order to bring the Rules up to date, and in particular to reflect the amendments made to the Children (Jersey) Law 2002 (the "2002 Law") by the Children and Civil Status (Amendments) (Jersey) Law 2024 (the "2024 Law").
Part 1 deals with introductory matters.
Rule 1 is an interpretation provision.
Rule 2 is an additional interpretation provision specifically providing the meaning of "proceedings".
Rule 3 sets out the jurisdiction of the Bailiff , Family Judge and Inferior Number of the Royal Court in relation to the various types of proceedings, and defines "Court" as whichever of the Bailiff , Family Judge or Inferior Number is relevant to the application or proceedings in question.
Rule 4 provides that the overriding objective of the Court in proceedings is to deal with cases justly, and provides the duties of the Court to give effect to the overriding objective.
Rule 5 provides that the Court must give effect to the overriding objective, in private law proceedings, by active case management. It further provides a non-exhaustive definition of active case management.
Part 2 deals with parental order proceedings. Applications for a parental order are a new kind of proceeding introduced by the 2024 Law.
Rule 6 provides the requirements for application for a parental order.
Rule 7 provides that respondents to the application must indicate their consent (or otherwise) to the application.
Rule 8 provides for the procedure if a respondent declines to provide consent under Rule 7.
Rule 9 provides for the appointment of a guardian ad litem of the child in respect of whom the order is applied for.
Rule 10 sets out the duties of the guardian ad litem and provides that the guardian must make a confidential report to the Court.
Rule 11 sets out the process for fixing a hearing date.
Rule 12 provides that an applicant for a parental order must attend the hearing in person. It further provides that in a joint application, the Court may dispense with the personal attendance of 1 of the applicants if that applicant provides a suitably attested declaration. Rule 12 provides that the hearing must be in camera.
Rule 13 provides that, within 7 days after the making of a parental order, the Judicial Greffier must direct the Superintendent Registrar to register the order and produce a parental order certificate for the applicants.
Part 3 deals with the commencement of proceedings other than parental order proceedings.
Rule 14 sets out the procedure to follow if a person is required to request the leave of the Court to commence proceedings.
Rule 15 provides the requirements for an application for a "welfare-based" order – this is an order made under Article 9C, 9D, 9E, 9F, 9H, 9N or 10 of the 2002 Law.
Rule 16 provides the requirements for an application for an order in public law proceedings – this is an order made under Article 22, 24, 26(5), 27, 30(6)(b), 33, 36(1), 37, 40, 41(5), 45(1) or 78(1) of the 2002 Law, or under Schedule 2 paragraph 4(1)(a), Schedule 3 paragraph 5(2) or Schedule 5 paragraph 3(3) to that Law.
Rule 17 provides the requirements for an application in private law proceedings – this is an order made other than as provided for in Rules 6, 15 and 16.
Rule 18 provides that commencement of welfare-based proceedings may be made ex parte by one party only, and sets out the procedure. It also clarifies that this does not limit the Court's jurisdiction to accept ex parte applications in relation to other kinds of proceedings.
Rule 19 provides for a situation in which a party to an application does not want to reveal their address to other parties to the proceedings.
Rule 20 provides the procedure and requirements for withdrawal of an application.
Rule 21 provides the parties to the proceedings. It introduces Schedule 1 paragraph 2, which sets out the respondents, and paragraph 3, which sets out the other people to whom an applicant must notify of the proceedings. This Rule further sets out the procedure for a person to be joined as a party to proceedings, or to cease to be a party to proceedings.
Rule 22 sets out how service may be effected under these Rules. Part 4 deals with matters preparatory to the hearing.
Rule 23 sets out the procedure in the case that the Court requires a report from the Jersey Family and Conciliation Service ("JFCAS").
Rule 24 provides for the directions that may be given by the Court. Rule 25 provides the procedure under which a hearing date is fixed.
Rule 26 sets out the duties of the Court and the applicants in relation to a case review hearing, and the actions that the Court may take at such a hearing.
Rule 27 provides that the usual case is that a party must attend a hearing or a directions hearing. It further provides an exception in that an applicant may be absent if they are legally represented, or if the Court considers it is in the interests of a child for the applicant to be absent. The Rule also sets out the powers of the Court to proceed or otherwise with a hearing in the event of non-attendance of an applicant or respondent.
Part 5 deals with evidence.
Rule 28 sets out the statements and evidence that may or must be provided before a hearing, and give details for filing them with the Court or serving on other parties.
Rule 29 states that a document that has been filed or served in proceedings must not be amended other than with the permission of the Court, and provides details as to how that permission may be obtained.
Rule 30 states that a person must not cause a child to be medically or psychiatrically examined without the leave of the Court (and that if leave is not granted, the evidence may not be presented without the leave of the Court). It further provides that the Court may meet the child to discuss the child's wishes and feelings, as long as JFCAS and the child both consent.
Rule 31 provides that, in proceedings under Article 22 of the 2002 Law, copies of all written reports must be made available before the hearing to the applicant, the parent or guardian of the child, the child's legal representation or person appointed under Article 75 of the 2002 Law, and the child (unless the Court otherwise directs).
Part 6 deals with hearings and making of orders.
Rule 32 sets out the order of speeches and evidence at a hearing, and provides that the Cout may give directions varying that order. It provides that the Court must state its findings of fact and reasons for its decision on making an order or refusing an application, and that a copy of an order made must be served on the specified people.
Part 7 deals with appeals.
Rule 33 sets out the procedure for an appeal against a decision of the Family Judge to the Inferior Number. Rule 34 sets out the procedure for appeals to the Court of Appeal.
Part 8 deals with miscellaneous matters.
Rule 35 provides that an ancillary document must not be disclosed to anyone other than a party, their legal representative, a person appointed under Article 75 of the 2002 Law, a JFCAS officer or a expert appointed by the Royal Court, without the leave of the Court. It provides that a document disclosed may not be further disclosed, and that the Court may grant disclosure subject to conditions.
Rule 36 provides that a person subject to a parental order may apply for disclosure of certain documents in relation to the making of that order. The Rule also sets out the procedure for making an application.
Rule 37 provides that documents ancillary to an application may be disclosed to the Health and Social Care Commission, the Office for Standards in Education, Children's Services and Skills, or an inspector of Children's Social Care Services or JFCAS, for the purposes of an inspection. The Court may grant access subject to the specified conditions.
Rule 38 provides that consent that is required under Article 16(3), Article 31(2)(b)(ii), Article 38(2)(b)(ii) of the 2002 Law or Schedule 2 paragraph 4(2)(c) or (d) to the 2002 Law may be given orally in the Royal Court or in writing, and provides a statement to be included with written consent.
Rule 39 provides the procedure if the Court includes exclusion requirements in an interim care order under Article 31(1) or in an emergency protection order under Article 38(1) of the 2002 Law.
Rule 40 provides for the procedure in the case that the Court gives a direction to the Minister under Article 29(1) of the 2002 Law.
Rule 41 provides that the costs of a transcript for the purpose of Rule 33(2)(c) or 34(2)(c) is borne by the appellant, unless the Court or Court of Appeal orders otherwise.
Rule 42 provides that the Bailiff , or the Family Judge with the Bailiff 's agreement, may issue practice directions.
Rule 43 is a transitional provision.
Rule 44 repeals the Children Rules 2005.
Rule 45 gives the citation and provides that these Rules come into force on the same day as the 2024 Law. The Rules were made on 20th November 2025 and came into force on 24th November 2025.
Children and Civil Status Amendment Rules 2025. Superior Number of the Royal Court.
The Children and Civil Status Amendment Rules 2025 amend the Adoption Rules 1962, the Matrimonial Causes Rules 2005 and the Royal Court Rules 2004 as a consequence of changes to the relevant legislation brought about by the Children and Civil Status (Amendments) (Jersey) Law 2024 (the "2024 Law") and the Civil Status (Abolition of Legitimacy Etc.) (Jersey) Law 2025 (the "Legitimacy Law").
Rule 1 amends the Adoption Rules 1962 in order to deal with situations in which there is a second parent (as defined in the 2024 Law), or in which a child is adopted who was the subject of a parental order. It also amends Schedule 1 to allow for more straightforward publication of court forms.
Rule 2 amends the Matrimonial Causes Rules 2005 to remove a reference to "illegitimacy", as this concept is abolished by the Legitimacy Law.
Rule 3 amends the Royal Court Rules 2004 to delete a reference to the Legitimacy (Jersey) Law 1973, which is repealed by the Legitimacy Law.
Rule 4 gives the citation and provides that these Rules come into force on the same day as the 2024 Law. The Rules were made on 20th November 2025 and came into force on 24th November 2025.
Children (Parental Responsibility Agreement) Rules 2025. Superior Number of the Royal Court.
The draft Children (Parental Responsibility Agreement) Rules 2025 –
• provide that a parental responsibility agreement must be made in the form published by the Judicial Greffier;
• give details as to how the agreement is recorded with the court; and
• repeal the Children (Parental Responsibility Agreement) Rules 2005.
The Rules come into force immediately after the Children and Civil Status (Amendments) (Jersey) Law 2024.
The Rules were made on 20th November 2025 and came into force on 24th November 2025.

"In relation to the £3 million Expenditure Growth Allocation to extend the provision of 15 hours per week of funded childcare to 2-3 year-olds, as referenced on page 44 of the Proposed Budget (Government Plan) 2026 to 2029, will the Minister advise –
- how many children aged two to three years are projected to benefit in 2026 from this funding, broken down between January to July 2026 and from September to December 2026;
- how much of the growth will be directed specifically to funding additional childcare hours, compared with the proportion allocated to other associated costs such as administrative support, workforce development, quality improvement, or capital investment, together with an explanation of what each cost category comprises;
- the proposed hourly rate that the Government intends to pay childcare providers and whether the rate is intended to cover full delivery costs;
- whether all providers will receive the same hourly rate;
- if a variable or tiered rate structure was considered, and why a single rate was ultimately selected; and
- what additional funding is available to those who provide Special Educational Needs or Disability (SEND) support and, if none, why not?"

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.
Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee. The current guidance was presented to the States in the report Time Limits on Speeches in Debates: Guidance on the Exercise of Discretion' (R.3/2021). The report states that discretion may be exercised to allow for a longer speech than 15 minutes where the member speaking is designated as the main respondent' to the debate.
