States of Jersey (Ministerial Offices) Amendment Order 2026. Chief Minister.

This Order establishes the Minister for Planning and Regulation and transfers some of the functions of other Ministers to the newly established Minister for Planning and Regulation. This Order also transfers some  functions  of  the  Minister  for  Sustainable  Economic  Development  to  the  Minister  for  the Environment.

Article 1 amends Article 1 of the States of Jersey (Ministerial Offices) Order 2022 (the "Ministerial Offices Order") to establish the Minister for Planning and Regulation.

Article 2 introduces Schedule 1, which amends other legislation to transfer some of the functions of the Minister for the Environment to the newly established Minister for Planning and Regulation.

Article 3 introduces  Schedule 2 and 3. Schedule 2 amends other legislation to transfer some of the functions of the Minister for Sustainable Economic Development to the newly established Minister for Planning and Regulation. Schedule 3 amends other legislation to transfer some of the functions of the Minister for Sustainable Economic Development to the Minister for the Environment.

Article 4  transfers  responsibility  for  the  Community  Provisions  (Food  Supplements)  (Jersey) Regulations 2014 from the Minister for Health and Social Services to the Minister for Planning and Regulation.

Article 5 gives the title of this Order.

Article 6 states that this Order comes into force on 14th July 2026 at the time it is made, except for Schedule 3, paragraph 2, which comes into force when Article 1 of the Agriculture and Fisheries (Loans) (Jersey) Law 2026 comes into force.

The Order was made on 14th July 2026 and came into force at 11.06 a.m. on the same day, except for Schedule 3, paragraph 2.

Employment and Discrimination Tribunal (Procedure) (Jersey) Amendment Order 2026. Minister for Social Security.

This  Order  amends  the  Employment  and  Discrimination  Tribunal  (Procedure)  (Jersey)  Order 2016 ("2016 Order") to increase the time within which a response to a claim must be presented to the Jersey Employment and Discrimination Tribunal, from 21 days to 28 days.

This Order also makes minor amendments to the 2016 Order and the Employment and Discrimination Tribunal (Members' Remuneration) (Jersey) Order 2024 for consistency with current drafting practice, but that do not affect their meaning or effect.

This Order comes into force 7 days after it is made.

The Order was made on 16th July 2026 and came into force on 23rd July 2026.

Cyber Security (Jersey) Commencement Order 2026. Minister for Sustainable Economic Development.

This Order provides that Parts 1, 2, 3 and 7 and Schedules 1, 2 and 4 of the Cyber Security (Jersey) Law 2026 come into force on 1 September 2026. It further provides that the rest of the Law comes into force on 1st December 2026.

Part 1 of the Law is an interpretation provision.

Parts 2 and 3 and Schedules 1 and 2 establish the JCSC and TACs and provide for their powers, duties, objectives and functions.

Part 7 provides for information sharing, transitional and final provisions, and (along with Schedule 4) consequential amendments.

The rest of the Law provides for the designation of operators of essential services (OESs), the security duties of those OESs, and enforcement of those duties.

The Order was made on 17th July 2026 and came into force on the same day.

Motor Traffic (Cabs – Fares and Charges) (Jersey) Amendment Order 2026. Minister for Infrastructure.

This Order amends the Motor Traffic (Cabs – Fares and Charges) (Jersey) Order 2017 (the "2017 Order") to increase the maximum fares and charges for the hire of a taxi.

The 2017 Order sets different maximum fees and charges depending on the time and day on which the hire of a taxi starts. This Order amends the maximum fares and charges as follows:

• for the hire of a taxi starting between 7 a.m. and 11 p.m. on a day that is not a Sunday, a bank holiday or during the Christmas or New Year period –

• the maximum fare for the first 176 yards or less of a journey is increased from £3.95 to £4.15;
• the maximum fare for each additional 176 yards of a journey is increased from 30p to 31p;
• the maximum waiting charge for each 51 seconds that the taxi is stationary is increased from 30p to 31p;

• for the hire of a taxi between 11 p.m. and 7 a.m. on any day or between 7 a.m. and 11 p.m. on a Sunday or public holiday, except for a day during the Christmas or New Year period –

• the maximum fare for the first 176 yards or less of a journey is increased from £4.05 to £4.40;
• the maximum fare for each additional 176 yards of a journey is increased from 42p to 43p;
• the maximum waiting charge for each 45 seconds that the taxi is stationary is increased from 42p to 43p;

• for the hire of a taxi during the Christmas or New Year period (between 7 p.m. on 24 December and 7 a.m. on 27 December, or between 7 p.m. on 31 December and 7 a.m. on 2 January) –

• the maximum fare for the first 176 yards or less of a journey is increased from £6.95 to £7.00;
• the maximum fare for each additional 176 yards of a journey is increased from 45p to 47p;
• the maximum waiting charge for each 28 seconds that the taxi is stationary is increased from 45p to 47p; and

• the charge for each passenger above 4 passengers being carried is increased from £1.00 to £2.00. This Order also makes minor amendments to the 2017 Order to remove references to bank holidays (as they are the same as public holidays, so there is no need to distinguish between bank holidays and public holidays) and to simply the definition of "public holiday".

This Order comes into force 7 days after it is made.

The Order was made on 21st July 2026 and came into force on 28th July 2026.

Criminal Justice (Young Offenders) Amendment No. 2 (Jersey) Commencement Order 2026. Minister for Justice and Home Affairs.

This Order provides that the Criminal Justice (Young Offenders) (Jersey) Amendment No. 2 Law 2026 comes into force on 1st August 2026. That Law amends the Criminal Justice (Young Offenders) (Jersey) Law 2014 to provide for the early or temporary release and supervision of young offenders serving youth detention in secure accommodation, a young offender institution or the prison. It also amends the Criminal Justice (Young Offenders) (Placement Panel) (Jersey) Regulations 2016, the Criminal Procedure (Jersey) Law 2018, the Prison (Jersey) Law 1957 and the Prison (Jersey) Rules 2007 for connected purposes.

The Order was made on 24th July 2026 and came into force on the same day.

This Order prescribes credit reference agencies for the purposes of Article 5A of the Register of Names and Addresses (Jersey) Law 2012 ("the Law"), which empowers the Chief Minister to supply to prescribed agencies certain registrable facts (name, residential address and date of birth) about individuals resident in Jersey who are aged 18 or over. The Order also prescribes the annual fee payable by an agency for supply of information under Article 5A of the Law.

Article 1 prescribes 2 UK-registered companies as credit reference agencies: Equifax Li mited and Experian Li mited.

Article 2 prescribes the annual fee of £1,750. This is the first Order prescribing a fee under Article 5A of the Law.

Article 3 gives the title of the Order.

Article 4 states that the Order comes into force on 30th July 2026.

The Order was made on 29th July 2026 and came into force on 30th July 2026.

Financial Services Commission (Financial Penalties) (Jersey) Amendment No. 2 Order 2026. Minister for External Relations.

This Order amends the Financial Services Commission (Financial Penalties) (Jersey) Order 2015 to amend the maximum level of penalty that the Jersey Financial Services Commission may impose on a principal person, a key person (each as defined in the Financial Services Commission (Jersey) Law 1998) or a person who performs or performed a senior management function in relation to a registered person. It also provides that a higher maximum penalty may be imposed on a principal person even if the principal person were also acting as a key person. It also makes minor amendments to insert a missed definition and to comply with modern drafting standards.

This Order comes into force on 1st September 2026.

The Order was made on 11th August 2026 and came into force on 1st September 2026.

Immigration (Fees) (Jersey) Amendment Order 2026. Minister for Justice and Home Affairs.

This Order amends the Immigration (Fees) (Jersey) Order 2022 (the "fees Order").

Article 2 amends Article 2(2) of the fees Order to increase, by between 6.3% and 6.7%, the fees payable for applications for limited leave to remain (other than for a person seeking limited leave to remain as an investor).

Article 2 also introduces fees for 2 new categories of limited leave to remain. The new categories are:

• A person seeking to enter Jersey to establish themselves in business; and

• A person seeking leave to remain as a Visitor (under paragraph V(J)2.5 of Appendix V(J) to the Jersey Immigration Rules).

Article 3 increases, by 0.5%, the fee payable for an application for indefinite leave to remain.

Article 4 replaces the table in Article 5(2) of the fees Order to increase, by between 7.9% and 8.1%, the fees payable when applying for any passport other than an emergency passport. The fee payable when applying for an emergency passport is increased by 25% if applying during office hours and by 36.1% if applying outside of office hours.

The fee increases in Articles 2 to 4 come into force on 1st September 2026. The increases are being made to ensure that fees charged in Jersey align with those charged in the United Kingdom and the rest of the Common Travel Area, and they have been approved by the Minister for Treasury and Resources.

The fees were most recently increased on 1st June 2025.

Article 5 replaces the table in Article 5(2) of the fees Order again on 16 November 2026, which is when an application for a passport (other than an emergency passport) can be made using a new fully online system. The fees payable for paper-based applications are unchanged from the 1 September 2026 fees, but new lower fees are introduced for fully online applications made using the new system. From 16 November 2026, a fee will no longer be charged for the return of supporting documents. Applications for emergency passports will remain only paper-based.

Article 6 names the Order, and Article 7 provides for the commencement dates outlined above.

The Order was made on 20th August 2026 and came into force on 1st September 2026, except for Article 5, which comes into force on 16th November 2026.

Social Security (Claims and Payments) (Jersey) Amendment No. 2 Order 2026. Minister for Social Security.

This Order amends the Social Security (Claims and Payments) (Jersey) Order 1974 (the "1974 Order").

A new Article 11A sets out, for the avoidance of doubt, the way in which the Minister calculates the start, change and end date of payments of 4 benefits – old age pension, survivor's benefit, long term incapacity allowance, and incapacity pension. The substance of Article 11A was found in Article 11(6) and (7) of the 1974 Order before it was removed earlier this year by the Social Security (Claims and Payments) (Jersey) Amendment Order 2026. It is anticipated that Article 11A will be removed in due course once the Minister has access to an IT system that affords them greater flexibility in timing the payment of these 4 types of benefits.

This Order comes into force on the day after it is made.

The Order was made on 25th August 2026 and came into force on 26th August 2026.

Termination of Pregnancy (Reporting) (Jersey) Order 2026.

Minister for Health and Social Services. This Order:

• prescribes the information that a registered medical practitioner must include in a notification required under Article 9(1) of the Termination of Pregnancy (Jersey) Law 2026 (the "Law"), with different information prescribed depending on whether the notification relates to a termination performed by administering medication, a termination performed by surgical procedure or a referral for a termination outside Jersey;

• requires medical practitioners to ensure that a notification is placed on the relevant patient's medical record and retained for at least 3 years;

• requires the Medical Officer of Health to publish the reports referred to in Article 13 of the Law on an annual basis, with reports to be published no later than the end of the year following the calendar year to which they relate.

This Order comes into force on 1st September 2026.

Termination of Pregnancy (Fees) (Jersey) Order 2026. Minister for Health and Social Services.

This Order sets the fees for termination services provided under the Termination of Pregnancy (Jersey) Law 2026 (the "Law").

The fees are as follows –

1. £0, if any of the following apply –

• the person receiving the service is under the age of 18, is receiving full-time education or lives in a household that receives income support;

• the pregnancy resulted from rape or incest;

• the termination is required due to 1 of the grounds described in Article 3(1)(b) of the Law (regardless of gestational age);

2. £185, if the person receiving the termination qualifies as a full eligible patient for publicly funded non-emergency healthcare on or after 1st September 2026 and none of the criteria in
   1. apply; or
   101. £511, in any other case.

The same fee is charged regardless of the method of termination.

This Order comes into force on 1st September 2026.

Cyber Security Law (Jersey) Amendment Order 2026. Minister for Sustainable Economic Development.

This Order amends the Cyber Security (Jersey) Law 2026 to amend the definition of "financial year", so that the initial truncated financial year applies only to the JCSC, and that a financial year in relation to an OES is always a full 12 months.

This Order comes into force at the same time as Article 1 of the Cyber Security (Jersey) Law 2026. The Order was made on 26th August 2026 and came into force on 1st September 2026.

In accordance with Standing Order 131(1)(b), the constitution of the Public Accounts Committee provides that (not including the Chair) there must be equal numbers of elected members (who are not Ministers or Assistant Ministers) and non-States members.

In accordance with Standing Order 124(2) any alternative nominations for membership of the Public Accounts Committee must have been received by the Greffier of the States no later than 2 clear working days before the meeting, namely no later than 5pm on 3rd September 2026. No alternative nominations were received.

Biographies

1. Clive Heal

Clive Heal has more than 35 years of international executive experience in procurement, commercial  management  and  organisational  transformation,  including  senior  leadership positions with global organisations such as Prudential, GSK, Roche and Genentech. He currently leads an artificial intelligence business and has extensive experience in procurement strategy, supplier governance, commercial negotiations and innovation. Clive brings specialist expertise  in  procurement,  commissioning,  value-for-money  assessment,  digital transformation and technology governance, together with significant experience of leading complex organisational change.

2. Mark Oliver

Mark Oliver is a qualified accountant and senior finance executive with more than 30 years of board-level experience across commercial and charitable organisations. His experience includes service as a Finance Director, Chair of an Audit and Finance Committee and Chair of an Investment Committee. Throughout his career he has been responsible for financial governance, budgeting, performance reporting, risk management and strategic planning, as well as supporting major organisational projects and commercial initiatives. Mark brings considerable expertise in audit, assurance, financial management, governance and value-for- money assessment.

3. Robert Duncombe

Robert Duncombe is a former NHS Chief Pharmacist with more than 20 years of senior leadership experience within major healthcare organisations, including The Royal Marsden NHS Foundation Trust and The Christie NHS Foundation Trust. His responsibilities included oversight of substantial medicines and staffing budgets, governance and risk assurance, workforce leadership and service improvement. Robert has also held national leadership roles within the pharmacy profession and has contributed to the development of policy and best practice across the health sector. He brings significant expertise in public-sector financial stewardship,  healthcare  governance,  workforce  leadership,  value-for-money  decision- making, and complex data systems.

Process

The appointment process for the non-elected members of the PAC was conducted through an open and competitive recruitment exercise. An advertisement was published locally on careers.gov.je and promoted through social media and a Li nkedIn campaign managed by the States Greffe. The vacancy was also circulated through the Jersey Chamber of Commerce's weekly e-newsletter. In addition, a note to the media was issued highlighting the recruitment campaign, which subsequently received local media coverage.

The advertisement sought experienced professionals with a demonstrable track record in one or more of the following areas:

• Audit, assurance and risk management, including experience of internal audit, external audit, audit committees or risk oversight.

• Financial management and public accountability, including budgeting, financial governance, performance reporting and value-for-money assessment.

• Corporate governance and organisational leadership, with experience of board level decision- making, accountability frameworks and governance improvement.

• Programme and project delivery, including oversight of major transformation programmes, capital projects or organisational change initiatives.

• Digital and technology governance, including technology strategy, digital transformation, cyber resilience or information governance.

• Health and workforce leadership, including workforce planning, organisational development or leadership within complex health or care organisations.

• Infrastructure, estates or asset management, including resilience planning, capital investment or management of critical public assets.

• Procurement, commercial management and commissioning, including contract management, service commissioning and supplier oversight.

• Human  resources  and  people  management,  including  workforce  strategy,  employment policies and organisational culture.

The aforementioned skills and experience are aligned with recommendations made in the previous PAC's Legacy Report, as well as the key themes arising from the work and recommendations of the Comptroller and Auditor General (C&AG), including matters raised by the C&AG in relation to critical resilience infrastructure and healthcare expenditure.

The Chair of the PAC was also keen to appoint individuals whose expertise would complement that of elected members and enhance the Committee's overall scrutiny capability. The addition of the proposed non-elected members will bring a broad range of skills, knowledge and experience, strengthening the Committee's ability to discharge its duties and responsibilities under the Public Finances (Jersey) Law and to undertake robust scrutiny throughout its four-year term.

In addition to relevant professional expertise, applicants were required to demonstrate strong analytical and communication skills, together with the ability to work constructively and collaboratively as part of a committee.

The recruitment exercise attracted a strong field of high-calibre applicants. A shortlisting process was undertaken to assess candidates against the published criteria, including their knowledge, experience, skills and motivation for seeking appointment to the Committee. Applicants identified as most closely meeting the requirements of the role were invited to interview. All shortlisted candidates were provided with additional information regarding the role, responsibilities and expectations of non-elected members. The shortlisting and interview panel comprised Deputy Karen Wilson as Chair of the PAC, the Greffier of the States and the Practice Director of the Law Officers' Department. A scoring matrix was used at both the shortlisting and interview stages to ensure candidates were assessed consistently and objectively. Eight applicants were shortlisted for interview, which took place on 19th and 20th August 2026.

Candidates were advised that non-elected members are not remunerated, and expenses are not ordinarily payable. Candidates were further advised that if successfully appointed, they would become signatories to the Code of Conduct for Lay Members of the Public Accounts Committee upon appointment, a draft copy of which was supplied to them in the information pack. For members' information, the code is appended to the most recent update to the Scrutiny and Public Accounts Committee Proceedings: Code of Practice.

Following the interviews, the panel unanimously agreed to recommend the appointment of the three nominees. In reaching its recommendation, the panel carefully considered the relative merits of all candidates, including their professional and academic backgrounds, and sought to ensure that the collective expertise of the non-elected members would complement and strengthen the knowledge and experience of the elected members serving on the PAC.

2. The Minister for the Environment tabled a revised answer on 13th July 2026 to the following question asked by Deputy H.L. Jeune of St. John , St. Lawrence and Trinity –

"Further to R.106/2026 and the proposed Order to separate planning and regulatory functions from the Minister's responsibilities and to create a Minister for Planning and Regulation, will the Minister –

1. set out where the revenue to fund her department will come from if the proposed changes take effect, specifically whether the income currently generated through planning and regulatory fees, licences and application charges will continue to be included;
2. advise what assessment, if any, has been made of the net financial impact to her department from the transfer of functions (and any potential associated fee income) to the new Minister for Planning and Regulation; and
3. inform the Assembly whether any transitional funding or budget reallocation has been agreed with the Minister for Treasury and Resources to ensure her department is not left with any shortfall as a result of the creation of the new role?"

3. The Minister for Social Security tabled an answer on 20th July 2026 to the following question asked by Deputy M.B. Andrews of St. Helier North –

"In relation to the minimum wage, will the Minister advise whether consideration is being given to –

1. setting different rates across industries and, if so, will she state who she plans to consult; and
2. a youth minimum wage rate and, if so, what age group will this rate apply to?"

4. The Minister for Education and Li felong Learning tabled an answer on 20th July 2026 to the following question asked by Deputy L.M.C. Doublet of St. Saviour –

"Will the Minister provide an update on the impact of the Jersey Pupil Premium programme, including any demonstrated improvement in educational attainment gaps?"

5. The Minister for Children and Families tabled an answer on 20th July 2026 to the following question asked by Deputy V. Li of St. Helier North –

"Further to the Minister's response to a question in the Assembly during his appointment as Minister, regarding children in Jersey at risk of grooming and criminal exploitation, will he –

1. provide details of any current measures (including multi-agency responses) that are in place to protect children identified as being at risk;

6. The Minister for Infrastructure tabled an answer on 20th July 2026 to the following question asked by Deputy M. Tadier of St. Brelade –

"Is the Minister aware of any calls from local residents and businesses to install additional pedestrian crossings on Route de la Baie, St. Brelade 's Bay, and will he advise whether it is his assessment that such crossings are needed to improve road safety for users of the Bay and, if so, what steps he is taking to deliver them and within what timeframe?"
