4.11   Deputy M. Tadier of St. Brelade of the Minister for Planning and Regulation regarding the Enforcement Notice issued to the owners of the former Nude Dunes site. (OQ.99/2026)

Will the Minister advise whether his Department is actively pursuing the Enforcement Notice issued to the owners of the former Nude Dunes site regarding the removal of an unlawful modular structure? If not, why not? If this is being pursued, when and how does the Minister expect to enforce compliance?

Senator Sir M.J. Boleat (The Minister for Planning and Regulation):

The enforcement notice remains in effect and has not been complied with. Non-compliance with the enforcement notice may be a criminal offence, and accordingly it would not be appropriate for me to comment further.

4.11.1   Deputy M. Tadier :

I suspected that might be the case. It is possible that the Minister may want to comment on whether - and I think he has implied it - the contravening structures are still in place. Can he confirm that the Enforcement Notices were first sent in August, but not August this year, August last year, so it has been well over 12 months since the requirement has been made to reduce that? If he is not able to answer the question, which I understand for the reasons he has outlined, could he perhaps answer the question as to whether he thinks that non-compliance over such a long period does anything to instil public confidence in his Department and the ability to uphold effectively the rule of law?

Senator Sir M.J. Boleat :

That is a really excellent point and it is a problem that I think I we grapple with. As I have said, what is going on now may be a criminal offence and it is very difficult to comment further, but it is clearly very unsatisfactory when there is an Enforcement Notice that is not complied with for a lengthy period, and I will do what I can to consider how we can best address this problem in the future. I agree it is unsatisfactory.
