REPORT
Background and purpose
The draft Treaties (Jersey) Law 202- ("the draft Law") is intended to provide a legal requirement for the States Assembly to approve different types of international treaties before they may be considered effective in Jersey.
The amendment concerns removing draft Article 5 which provides that a treaty signed by the Attorney General in exercise of law enforcement functions must be laid before the States Assembly for information within 28 days of signature together with an explanatory memorandum. The reason for the proposed change is to further rationalise the draft Law as law enforcement agreements generally take the form of memoranda of understanding, which are not treaties. Where, on the rare occasion, they may take the form of a treaty signed under Letter of Entrustment, draft Article 2 provides the appropriate route for States Assembly engagement.
Accordingly, it is proposed that draft Article 5 is deleted.
