THE STATES, having been informed that the relevant scrutiny panel had indicated that it did not wish to scrutinise the draft legislation, commenced consideration of Articles 1 to 6, and, adopting an amendment of the Minister for Justice and Home Affairs (P.8/2026 Amd.), agreed that in Article 1 –

  1. in Article 1(2), after "A has a defence if" there should be inserted "A proves, on the balance of probabilities, that"; and
  2. in Article 1(3), for the definition "strangle" there should be substituted – "strangle" includes –
  1. to suffocate;
  2. to choke;
  3. to restrict a person's breathing by any means; and
  4. to restrict the flow of blood to a person's brain by any means.".

Bailiff 's Consultative Panel – amendment to Terms of Office P.13/2026

THE STATES, adopting a proposition of the Privileges and Procedures Committee entitled Bailiff 's Consultative Panel – amendment to Terms of Office' (P.13/2026), agreed to refer to their Acts dated 7th July 1992, 4th February 2003 and 16th May 2006, in which they had agreed to establish a Consultative Panel of elected members of the States with whom the Bailiff would be able to meet in order to consult on a confidential basis in appropriate cases and, subsequently, to amend the constitution of the Panel, and agreed that, after the elections to the States Assembly on 7th June 2026 –

  1. those Members elected to the Panel by ballot should be chosen at the same meeting as that at which (in accordance with Standing Order 112) the Members of Scrutiny Panels were chosen; and
  2. the term of office for Members elected to the Panel by ballot should align with the election cycle.
