International Co-operation (Protection from Liability) (Jersey) Amendment Order 2026 Chief Minister.

This Order amends the International Co-operation (Protection from Liability) (Jersey) Order 2024 to decrease the maximum amount of a public authority's liability in damages, loss or costs in certain types of proceedings, from £75,000 to £50,000. It also excludes proceedings in relation to a public authority's actions under the Taxation (Implementation) (Jersey) Law 2004 from those where damages, loss or costs may be awarded.

The Order comes into force on the day after it is made.

The Order was made on 25th February 2026 and came into force on 26th February 2026.

Road Traffic ( St. Saviour ) (Jersey) Amendment Order 2026 Minister for Infrastructure.

This Order amends the Road Traffic ( St. Saviour ) (Jersey) Order 2000. The Order, as well as correcting the spelling of certain roads:

1. reduces the length of the one-way traffic route in La Rue de la Houguette (Article 2);
2. extends the prohibition on waiting on St. Saviour 's Hill, Maison St. Louis, Little Sunshine Avenue and Sunshine Avenue, La Rue à la Dame and Grands Vaux (Article 3);
3. adds Little Sunshine Avenue and Sunshine Avenue to the list of roads closed to through traffic (Article 4); and
4. provides for disc parking of up to 3 hours in La Rue à la Dame and St. Saviour 's Hill (Article 6).

This Order comes into force 7 days after it is made.

Royal Court Amendment Rules 2026. Superior Number of the Royal Court

The draft Royal Court Amendment Rules 2026 amend Part 14 of the Royal Court Rules 2004, which deals with the procedures to be followed for a Vue de Vicomte and a Vue de Justice.

Rule 14/1(4) is amended to reduce the number of experts summoned by the Viscount to 5.

Rule 14/1(6) is amended to remove the peremptory challenge whilst retaining the challenge for cause. Rule 14/1(7) is amended by reducing the number of experts for a Vue de Vicomte to 3.

Rule 14/2(2) is amended by reducing the number of experts for a Vue de Justice to 7, none of whom participated in the Vue de Vicomte.

Rule 14/2(3) is deleted.

Rule 14/2(4) is amended by the deletion of the word "additional" and the removal of the reference to summoning the original experts whose decision is challenged.

Rule 14/2(5) is amended by the deletion of the word "additional". Rule 14/2(7) is amended by removing the reference to the experts.

Immigration (Electronic Travel Authorisations) (Jersey) Commencement Order 2026. Minister for Justice and Home Affairs.

This  Order  brings  into force,  7 days  after  the  Order  is  signed,  the  Immigration  (Electronic  Travel Authorisations) (Jersey) Order 2025. That Order is an Order in Council extending to Jersey section 75 of the Nationality and Borders Act 2022 of the United Kingdom. That Act amends the Immigration Act 1971 of the United Kingdom and the Nationality, Immigration and Asylum Act 2002 of the United Kingdom, as they are extended to Jersey by the Immigration (Jersey) Order 2021. The effect of the amendments being brought into force is as follows –

• they give the Minister for Justice and Home Affairs (the "Minister") a power to make immigration rules to require Electronic Travel Authorisations for travel to Jersey;

• they give the Minister a power to make an Order dealing with the effect of Electronic Travel Authorisations that are granted or refused in the United Kingdom, the Bailiwick of Guernsey or the Isle of Man;

• they give the Minister a power to request that the United Kingdom's Secretary of State carries out functions related to the granting of Electronic Travel Authorisations;

• they give the States a power to make Regulations to require an applicant for an Electronic Travel Authorisation to provide biometric information;

• they make it an offence to use deception to obtain, or seek to obtain, an Electronic Travel Authorisation.

The Order was made on 4th March 2026 and came into force the same day.

Control of Borrowing (Jersey) Amendment Order 2026. Minister for External Relations.

This Order amends the Control of Borrowing (Jersey) Order 1958 (the "COBO") and makes consequential amendments to related legislation.

The COBO specifies a range of transactions (including borrowing and other forms of capital raising, the formation of bodies corporate and unincorporated, and the issue of shares, securities and other interests) that  must  not  take  place  without  the  consent  of  the  Jersey  Financial  Services  Commission  (the "Commission").

Article 2 amends the COBO to remove that consent requirement in relation to certain transactions.

Paragraph (2) inserts the definition "retail investor", for the purposes of Articles 8, 10(1)(c), 11(1)(c) and 11A(1)(c) as amended by this Order.

Paragraph (3) deletes Article 7, which required the Commission's consent to the issuing of Government securities that were to be registered in Jersey, other than securities of the Government of the United Kingdom or the States of Jersey or Guernsey.

Paragraph (4) amends Article 8, which requires the Commission's consent to the circulation in Jersey of an offer for subscription, sale or exchange (a "prospectus") in relation to certain securities and units in a unit trust scheme. The effect of the amendment is that the Commission's consent is required only if the prospectus is issued by a person that is not incorporated or established in Jersey and is circulated to retail investors in Jersey.

Paragraph (5) amends Articles 10(1)(c), 11(1)(c) and 11A(1)(c), which require the Commission's consent to the circulation in Jersey of prospectuses in relation to certain partnership interests and interests in limited liability companies. The effect of the amendments is that the Commission's consent is required only if the prospectus is issued by a person that is not incorporated or established in Jersey and is circulated to retail investors in Jersey.

Paragraph (6) amends Article 14, so that the requirement to obtain the Commission's consent –

1. under Article 1(2), 3(1), 9(1)(a) or (b), 10(1)(a) or (b), 11(1)(a) or (b) or 11A(1)(a) or (b) does not apply to a non-Jersey domiciled entity unless it is an investment fund;
2. under Article 9(1)(a) or (b) does not apply to a Jersey unit trust unless it is an investment fund.

Paragraph (7) inserts new Article 14A, which makes provision about consents granted by the Commission before this Order comes into force. It states that if a consent described in Article 14 (as amended by paragraph (6)) was granted before 13th April 2026, the consent is no longer required from that date and is treated as no longer having effect. And it states that the amendments made by this Order do not affect the validity of anything done in reliance on consent granted by the Commission under the COBO before this Order comes into force.

Articles 1, 3 and 4 make consequential amendments to remove references to consent under the COBO from, respectively, the Collective Investment Funds (Restriction of Scope) (Jersey) Order 2000, the Financial Services (Investment Business (Restricted Investment Business – Exemption)) (Jersey) Order 2001  and  the  Financial  Services  (Investment  Business  (Special  Purpose  Investment  Business  – Exemption)) (Jersey) Order 2001.

Article 5 gives the name of this Order and states that it comes into force on 13th April 2026. The Order was made on 5th March 2026 and comes into force on 13th April 2026.

Financial Services Commission (Financial Penalties) (Jersey) Amendment Order 2026. Minister for External Relations.

This Order imposes a cap on the maximum level of penalty that can be imposed by the Financial Services Commission on a registered person under the Financial Services Commission (Financial Penalties) (Jersey) Order 2015.

Article 1 states that the Order amends the Financial Services Commission (Financial Penalties) (Jersey) Order 2015.

Article 2 limits the maximum level of penalty imposed on a registered person in band 1 to £100,000, in band 2 to £4,000,000 and in band 2A to £4,000,000.

Article 3 gives the name of this Order and provides for it to come into force 7 days after it is made. The Order was made on 5th March 2026 and comes into force on 12th March 2026.

Financial Services Commission (Proceeds of Penalties) (Jersey) Order 2026. Minister for External Relations.

This Order requires the Financial Services Commission to pay to the States money received by the Commission in respect of penalties in specified circumstances.

Article 1 sets out a definition.

Article 2 requires the Commission to pay to the States money received in respect of penalties, after deducting the costs of enforcement and the amount offset against fees in accordance with Article 21G(2) of the Financial Services Commission (Jersey) Law 1998. The Commission must report annually to the States about the amount of penalties received, the costs of enforcement and the amount to be offset against fees and must make payment within 30 days after receipt of notification from the Minister of the amount to be paid.

Article 3 gives the name of the Order and provides for it to come into force 7 days after it is made. The Order was made on 5th March 2026 and comes into force on 12th March 2026.

Companies (General Provisions) (Jersey) Amendment Order 2026. Minister for External Relations.

This Order amends the Companies (General Provisions) (Jersey) Order 2002 ("the 2002 Order") to provide that Part 3 (prospectuses) does not apply to certain secondary issuances of securities, and amends the definition "prospectus" in the Companies (Jersey) Law 1991 ("the Law") to provide that these secondary issuances are not considered to be invitations to the public. This Order also amends the 2002 Order to increase the amount of general bond that a person must have in place to qualify for registration as an approved liquidator.

Part 1 amends the 2002 Order.

Article 2 corrects a cross-reference to the Law contained in Article 2 of the 2002 Order.

Article 3 amends Article 3 of the 2002 Order (application) to provide that Part 3 of the 2002 Order (prospectuses) does not apply to certain secondary issuances of securities.

Article 4 amends Article 7 of the 2002 Order to increase the amount of general bond (from £250,000 to £750,000) that a person must have in place when applying for registration or re-registration under Article 7(2C) of that Order. While a person whose name is already entered in the Register of Approved Liquidators must have in place the increased amount of general bond when applying to re-register, their current period of registration is not affected by the amendment.

Part 2 provides for an amendment of the Law. Article 6 amends the definition "prospectus" in Article 1 of the Law.

Part 3 contains the final provisions.

Article 7 provides for citation and commencement. Article 4 comes into force 2 months after this Order is made, and the rest of this Order comes into force the day after this Order is made.

The Order was made on 5th March 2026, Article 4 comes into force on 6th May 2026 and the rest of the Order came into force on 6th March 2026.

Collective Investment Funds (Certified Funds – Prospectuses) (Jersey) Amendment Order 2026. Minister for External Relations.

This Order amends the Collective Investment Funds (Certified Funds – Prospectuses) (Jersey) Order 2012 (the "2012 Order") to provide for additional circumstances in which a certificate holder is exempt from the requirement to prepare a prospectus under the 2012 Order. The new exemption relates to the secondary issuances of securities that are excluded from the definition "prospectus" in the Companies (Jersey) Law 1991 by the Companies (General Provisions) (Jersey) Amendment Order 2026.

Article 2 of this Order replaces Article 1A of the 2012 Order to provide for a new exemption from compliance with the Order. The effect of the amendment is that a certificate holder is not required to prepare a prospectus for the issue of units being marketed that relates to an admission to trading within Article 3(3) or (6) of the Companies (General Provisions) (Jersey) Order 2002. The existing exemption for a certified fund of a type described in Schedule 2 to the 2012 Order is retained.

Article 3 of this Order provides for citation and commencement. This Order comes into force the day after it is made.

Finance (2026 Budget) (Jersey) Commencement Order 2026. Minister for Treasury and Resources.

This Order provides for Articles 25 and 53 of the Finance (2026 Budget) (Jersey) Law 202- (which make provision in relation to the introduction of excise duty on liquids used in vapes) to come into force on 11 May 2026. The rest of the Law came into force on 1st January 2026.

The Order was made on 6th March 2026 and came into force on the same day.

Bank (Recovery and Resolution) Amendment (Jersey) Commencement Order 2026. Minister for External Relations.

This Order provides for the commencement of the Bank (Recovery and Resolution) (Jersey) Amendment Law 2025 (the "Amendment Law"), which amends the Bank (Recovery and Resolution) (Jersey) Law 2017 (the "2017 Law") and other enactments to provide for –

1. the continuation of the Bank Depositors Compensation Scheme; and
2. the transfer of functions to the Jersey Resolution and Depositors Compensation Authority ("the Authority") for the administration of that Scheme.

Article 54(1) and (3) of the Amendment Law come into force 7 days after this Order is made and replace "financial year" with "final reporting period" within Article 14 (accounts and reports) of the Banking Business (Depositors Compensation) (Jersey) Regulations 2009.

The majority of the remaining provisions of the Amendment Law come into force on 1 April 2026, to give effect on that date to the transfer of functions from the Jersey Bank Depositors Compensation Board ("the Board") to the Authority. Article 54(2) and (4) come into force on that date, providing for the Board to continue in existence until 1st July 2026 for the purpose of fulfilling its functions in relation to the final reporting period (which ends on 31st March 2026).

The rest of the Amendment Law comes into force on 1st July 2026, at the end of the 3-month period allowed for the orderly dissolution of the Board. Accordingly, under new Article 142B of the 2017 Law, the assets, rights and liabilities of the Board are transferred to the Authority on 1st July 2026.

The Order was made on 6th March 2026 and came into force on the same day.

Banking Business (Depositors Compensation) (Jersey) Order 2026. Minister for External Relations.

This Order is made under the combined powers in Article 51 of the Banking Business (Jersey) Law 1991 (the  "Law")  and  Regulation 14(11)  of  the  Banking  Business  (Depositors  Compensation)  (Jersey) Regulations 2009 (the "2009 Regulations").

Regulation 14(11) is inserted into the 2009 Regulations by Article 54(3) of the Bank (Recovery and Resolution) (Jersey) Amendment Law 2025, which comes into force 7 days after the Bank (Recovery and Resolution) Amendment (Jersey) Commencement Order 202- is made. Regulation 14(11) defines "final reporting period" as ending on a date specified by Order under Article 51 of the Law.

The effect of this Order is that the final reporting period will end on the 31st March 2026, which is the last date on which the Jersey Bank Depositors Compensation Board has responsibility for administering the Bank Depositors Compensation Scheme.

Article 1 of this Order specifies 31st March 2026 as the end date of the final reporting period. Article 2 of this Order provides for citation and commencement.

This Order comes into force on the day after the day that Article 54(3) of the Bank (Recovery and Resolution) (Jersey) Amendment Law 2025 comes into force.

The Order was made on 6th March 2026 and comes into force on 14th March 2026.

3. whether the system is compatible with General Practitioner (GP) recording systems, and if not, why not;

4. The Minister for Infrastructure tabled an answer on 2nd March 2026 to the following question asked by Deputy D.J. Warr of St. Helier South –

"Will the Minister provide a full schedule of the maintenance works that his department intend to carry out in the period before the new operator of the site takes over, in order to ensure public safety at Havre des Pas Bathing Pool, and if there are no such scheduled works, advise why not?"

5. The Minister for Social Security tabled an answer on 2nd March 2026 to the following question asked by Deputy C.D. Curtis of St. Helier Central –

"Will the Minister provide detail on what support, if any, is available specifically for Armed Forces Veterans to return to regular employment, and if no such support exists, explain why not?"

6. The Minister for the Environment tabled an answer on 2nd March 2026 to the following question asked by Deputy M. Tadier of St. Brelade –

"Will the Minister advise –

1. the current policy on taking action on breaches of planning enforcement notices where there is a live application on the property pending decision, and if no policy exists, explain why not;

7. The Minister for Sustainable Economic Development tabled an answer on 2nd March 2026 to the following question asked by Deputy J. Renouf of St. Brelade –

"Will the Minister advise, for each of the last 10 years, the total number of –

1. inter-Island passengers travelling by air;
2. inter-Island passengers travelling by sea; and
3. inter-Island vehicle movements?"

In accordance with Standing Order 104A, a time limit of 15 minutes applies to speeches made during debate, unless discretion has been exercised to allow for a longer, or shorter, time limit. No time limit applies to either speech made by the proposer.

Discretion is exercised by the Presiding Officer in accordance with guidance issued by the Bailiff , following consultation with the Privileges and Procedures Committee.
