WRITTEN QUESTION TO THE MINISTER FOR PLANNING AND REGULATION BY DEPUTY H.L. JEUNE OF ST. JOHN, ST. LAWRENCE AND TRINITY
QUESTION SUBMITTED ON MONDAY 28th SEPTEMBER 2026
ANSWER TO BE TABLED ON MONDAY 5th OCTOBER 2026
Question
"Further to the Dangerous Building Notice issued on 29th May 2026 in relation to the properties known as Ashton Villa (106) and Channel Mews (108), situated on Rouge Bouillon, St. Helier , will the Minister advise –
- whether the remedial works constituted a permanent or a temporary repair;
- if the remedial works were a temporary repair, the extent of, and responsibility for, any further work required, and the timeframe for this work to take place;
- the total cost to the Government of the remedial works and traffic management measures, the costs recovered to date and steps to be taken to recover any remaining costs from the property owners; and
- whether any enforcement action has been taken or will be taken for non-compliance with the Dangerous Building Notice?"
Answer
- The works specified in a dangerous building notice are limited to those works required to make the building safe, and the direct action taken did not include further repairs of a permanent or temporary nature. The site was handed over in a safe condition to the landowners, and any further repairs or works are the responsibility of the owners.
- Any further works required to reconstruct the walls are the responsibility of the owners of the land.
- Works related to removing the danger amounted to £23,390.67 as follows:
• Engineer's report and oversight: £1,159.20
• Main contractor: £18,484.99
• Emergency electricity work: £3746.48
Road closure and traffic management costs totalled £3,133.50 Commented [AM1]: Awaiting costs for road closure and
traffic management from Infrastructure, to be confirmed later this morning (01/10/2026)
Officers are at present in the process of determining the proportion of costs to be assigned and recovered from the respective owners pursuant to Art.69 of the Planning and Building (Jersey) Law 2002, and the issuing of invoices is imminent. Failure to pay the reasonable costs will result in debt recovery in accordance with appropriate debt recovery procedures in association with the Law Officers Department.
- The undertaking of the works in default under Art.69 of the Planning and Building (Jersey) Law 2002 constitutes enforcement action. Failure to comply with a dangerous building notice is an offence under Art.70 of the Law, and the Regulation Directorate is presently carefully considering its position, taking into account the guidance provided by the LOD regarding referrals of regulatory breaches, and acknowledging that the Attorney General is the ultimate authority in respect of all prosecutions in the Island.
