Corporate Services Scrutiny Panel Memorandum of Understanding - States-owned entities
Thank you for your letter dated 6th August 2020.
The Corporate Services Scrutiny Panel (the Panel) is pleased that the Memoranda of Understanding (MoU) are nearing finalisation and are grateful to receive the generic template being used. There is a concern that approaching these in a generic manner will not take into account the specific circumstances of each of the Arm's Length Organisations (ALOs). Therefore, the Panel requests a list of the ALOs which are in the process of reviewing their MOUs, as well as the drafts of each MoU be forwarded. If at a stage to do so, please can you also forward copies of law drafting instructions pertaining to these.
We consider it imperative that Scrutiny is given the opportunity to review the proposed new MoUs. Will you therefore please confirm that no revised form of MoU will be entered into without Scrutiny having first been afforded the opportunity to conduct such review.
The Panel has requested copies of minutes of shareholder meetings with the States-owned entities as Treasury's relationship with ALOs is of critical importance to the public, and the Panel's remit necessitate scrutiny of these relationships as a matter of course.
