COMMENTS
This amendment asks that both the Emergency Department (ED) and Did Not Attend (DNA) fee proposals are brought back to the Assembly in 2026 for consideration and decision before implementation.
The Council of Ministers accepts the related amendment 16 (as lodged by the HSS Panel) and agrees that the proposed new Emergency Department fee will not be introduced until after detailed, evidence-based proposals have been presented to the States Assembly.
The Council of Ministers does not, however, accept that the proposed Did Not Attend fees requires consideration by the Assembly on the basis that:
- the Minister has already committed to not introduce the DNA fee until after a period of advanced public communications and subject to the roll out of a new patient appointment system that allows patients to directly manage their own appointments
- the DNA fee is a fee incurred for non-attendance, and hence the risk of it acting a barrier to accessing care is limited particularly given that specific groups of people will be exempt including, but not limited to, children and mental health patients. Whereas conversely, the ED fee is a fee incurred for attendance – albeit inappropriate attendance - hence there is more risk that it could act as a barrier to accessing care.
